Despite several attempts to do so, there has been no act adopted entirely to regulate this matter. The existing provisions refer only to the problem of nagging smells and norms that might reduce their intensity. In the author’s opinion efficient protection against burdensome odours must be accounted for already at the stage when new installations are made. Firstly, new investments should be located at a distance from residential districts. It may be helpful to plant green belts that would absorb the smell produced and emitted in the environment. Another solution is an obligatory requirement to invest in technology reducing the emission of odours.Item Prawne aspekty uboju rytualnego(Wydawnictwo Naukowe UAM, 2016) Jachnik, ElizaThe aim of this paper was to present the relationship between the animals’ welfare and their humane treatment and the ritual slaughter driven by religious views, and arising from it numerous legal issues. The analysis was made on the basis of the international, European and Polish law. It has been concluded that ritual slaughter ought to be treated as a religious practice or tradition and be evaluated on the basis of the fundamental principles of the freedom of religion. However, some restrictions may nevertheless be implemented to protect morality and be justified by the universally recognised principle of humane treatment of animals. The current norms and regulations allow for the industrial-scale ritual slaughter which is an abuse of animals’ welfare and their humane treatment. Pierwsza część artykułu opisuje krótko genezę podpisania Konwencji o ochronie praw człowieka i godności osoby ludzkiej w odniesieniu do zastosowań biologii i medycyny, powody oraz cele jej podpisania, a także jej specyfikę. Z drugiej części możemy dowiedzieć się czym jest testament życia, czy łączy się on z pojęciem eutanazji, co rozumiemy pod pojęciem terapii uporczywej, a także czym są oświadczenia pro futuro. Część trzecia przywołuje i poddaje analizie poszczególne artykuły omawianej konwencji, które dotyczą wprost oświadczeń pro futuro. Część czwarta poświęcona jest praktycznym problemom, które mogą powstać przy próbie prawnego unormowania zagadnienia testamentu życia.Item Wybrane aspekty prawne zagospodarowania pozostałości poprodukcyjnych z wielkotowarowych ferm zwierząt gospodarskich w Polsce(Wydawnictwo Naukowe UAM, 2015) Jachnik, ElizaThe technological progress and growing demand for food are conducive to the devel-opment of industrial agriculture. The impact of industrial agriculture on the environment is much greater than that caused by traditional agriculture. Major dangers come from post-production residue. More precisely, they are animal faeces. The author of this paper made an attempt to categorise animal faeces. The question asked was whether they belong to the category ‘wastage’ or ‘by-products’. Another issue discussed was proper management and utilisation of animal faeces and an assessment of the existing legal regulations to establish whether they guarantee satisfactory protection of the natural environment against the negative impact of intensive animal production. It has been found that the current legislation on the matter researched is not satisfactory and requires amendments.
