It reviews the audit of such public procurement carried out by the various inspection bodies and different methods of control. The first part of the study contains the characteristics of inspection bodies which carried out audits of public procurement contracts and whose subject matter was sea shore protection structures. It is also indicated that although indirectly, tax revenue agencies, administrative courts and the Ombudsman play an important role in the system. For the purposes of moving on to the discussion of particular types of inspections carried out by various public bodies and courts. In the article, certain works consisting in strengthening the sea shore have been assigned to the category of hydrotechnical structures, which allowed to move on to the discussion of particular types of inspections carried out by various public bodies and courts and to cite conclusions formulated on their basis. The concept of “coastal protection of the marine environment,” which underpinned the adoption of the resolution of the Supreme Administrative Court of 11 December 2017, ref. I FPS 2/17 was also analysed in detail. In this resolution the position of the authoress of this article, expressed earlier in the commentary to the judgment of the Supreme Administrative Court of 14 April 2015, ref. I FSK 1493/14 and published in “Studia Prawa Publicznego” 2016, no. 1 was shared. The conclusion of the deliberations is that the system for controlling public procurements of services related to maritime coast protection is not coherent and mutually supportive. At the beginning, the author defines the scope of licensing, pointing out its limitations in comparison with the previous state, and analysing regulations which define terms and conditions for making new licenses legally binding. She evaluates performing the duty imposed on the legislator in article 98 section 1 of the Polish Business Activity Law Act, which concerns defining in separate acts the scope and conditions for performing the business activity and the legal consequences o f a failure to fulfil this duty. A considerable part o f the article refers to such procedural issues as legal regulations concerning refusal to issue a license, a revocation or alteration of a license. The author evaluates these legal solutions, underlying the changes introduced by the legislator in comparison to the previously binding regulations. She analyses institutions that so far have been unknown in the license proceedings, such as the preliminary control institution and the administrative trial institution applied in a situation when the body intends to issue a limited number of licenses. She also points out solutions concerning the possibility to revoke a license. On the basis of an analysis of legal regulations as well as views presented in publications and judicial decisions, she characterizes legal decisions concerning licensing. The author pays a lot of attention to the position o f the licensing body in the license proceedings. Therefore, she analyses article 16 section 1 of the Polish Business Activity Law Act, according to which it is the licensing body that specifies the terms and conditions for performing a business activity which is subject to licensing. The author points out the differences between the act on business activity dated 1988 and the Polish Business Activity Law Act with respect to the way in which the licensing body is bound with the promise. Another issue discussed in the article concerns the validity of a license issued still before the Polish Business Activity Law Act came into force. At this point she also discusses licenses issued to civil partnerships.Item POSTĘPOWANIE W SPRAWIE UDZIELANIA OGRANICZONEJ LICZBY KONCESJI(Wydział Prawa i Administracji UAM, 2005) Trela, AnnaThe paper enlists the main changes in the concessioning o f business activity which were implemented after the Act on Freedom of Economic Activity was adopted on 2 April 2004, and it discusses the consequences of the reduced number of the types of business activity that are subject to concessioning, and the manner in which special terms and conditions of carrying out certain business activities are determined. Special attention is given to the institution of a tender which aims at identifying the number and type of potential concessions if their number is to be limited. General provisions relating to the procedures prior to the tender are discussed and compared with specific solutions regulated in the Act on radio and television of 29 December 1992. Further, the main elements of a tender implemented in the Act on Freedom of Economic Activity are presented in relation to the solutions of the civil code, and the manner of their regulation as well as the role of the tender in the concessioning process are discussed. It may also be noted that the regulations of the decision-making process contain specifi c legal solutions which impose on the administrative body a duty to establish and assess the actual state of affairs and to refer to the intended one. In German science of public law, such manner of setting standards or regulating tasks of public administration is termed ‘freedom to predict’. This subject is analysed in the practical as well as theoretical sphere. Thus, it was fi rst necessary to focus on the legal forms of the functioning of public administration, different ‘gaps’, or freedoms in deciding by administrative bodies, and the judicial (court) manner of their supervision. Provisions of the Energy law of 10 April 1997 are certainly a refl ection of the regulation of this ‘freedom to predict’. The authoress places this freedom within the framework of discretionary powers requiring an assessment of a situation in the context of the intended (future) condition. The following have been analysed: availability of fi nancial resources guaranteeing that the applicant will be capable of proper conduct of economic activity, and documenting the possibility of procuring the necessary funds, availability of technical resources ensuring proper execution of business, human resources and availability of appropriately qualifi ed personnel. Another premise is a warranty of performance of the activity under concession, including observance of energy safety and energy policy provisions.
