This concerns a situation in which, by way of functional interpretation, judges amend the statutory norm that determines the manner in which certain goods are distributed. The basic ethical problem arises when the grounds for the rejection of a clear result of linguistic interpretation adopted by the judges gives rise to serious doubts as to its adequacy in the light o f the adopted assumption of the axiological rationality of the legislator. This, in consequence, may lead to a suspicion that the court that has decided in a given matter followed an opinion o f a certain social or political group. In the author’s opinion, in matters concerning the distribution of goods that could not be politically resolved on the parliamentary forum, or in cases where parliamentary inaction might put the citizens’ welfare at risk, a change in the statutory norms of the distribution of goods performed by the court by rejection of a clear result o f linguistic interpretation, in a situation o f a dispute regarding the assumptions of the axiological rationality of the legislator is acceptable, and the described behaviour does not infringe the basic ethical obligation of a judge to make a sovereign decision.Item DEFINICJA LOBBINGU WEDŁUG USTAWY Z 7 LIPCA 2005 R.(Wydział Prawa i Administracji UAM, 2007) Kuczma, PawełIn Poland the term lobby has a number of meanings, which is undoubtedly the result of an absence o f a comprehensive and full legal regulation of this particular institution. The first part of the paper is therefore devoted to definitions of ‘lobby’ formulated in non-legal literature. Then, legal definitions of lobbying that operate in selected states (USA, Australia, Canada, Georgia and Lithuania) are presented. The last part of the paper contains presentation of common features of the analysed definitions. The terms „interest groups” as well as „lobby groups” with reference to the Private Members’ Bills concerning the phenomenon o f lobbying are also discussed. In its essence, the paper is a somewhat critical characteristics o f the Polish definition o f ‘lobbying’ shown on the basis of several problems that arose in the process o f the work o f the parliamentary Extraordinary Committee. The paper shows the co-existence relations between the Polish legal system, Community law and the system of European Convention for the Protection of Human Rights, as well as their impact on the adjudication process. The conclusions drawn in the paper are based mainly on the jurisdiction of the European Court of Justice and the European Court of Human Rights.Item SPRAWOZDANIA I INFORMACJE. KOMUNIKAT O IV KONKURSIE IMIENIA PROFESORA ZYGMUNTA ZIEMBIŃSKIEGO(Wydział Prawa i Administracji UAM, 2007) Piotrowski, MariuszItem REALIZACJA MIĘDZYNARODOWYCH STANDARDÓW OCHRONY DZIEDZICTWA KULTURALNEGO W POLSKIEJ USTAWIE O OCHRONIE ZABYTKÓW I OPIECE NAD ZABYTKAMI(Wydział Prawa i Administracji UAM, 2007) Gerecka-Żołyńska, AnnaThe paper presents the Polish model o f monument protection and its short genesis described in the systematic order of the Act on protection and care of monuments of 2003. First, issues related to the object of protection have been identified, with particular focus put on the status of objects of special archaeological value. This was done because interesting solutions adopted in regard those objects, with respect to the conditions of excavations, and the duties and obligations arising from their discovery and the need for securing archaeological findings have been reflected in the text of the Polish Act. After that, consequences resulting from the distinguishing of two notions: „protection” and ‘care’ have been shown., with an indication, that the Act introduced the notion of „care” in respect of monument protection in the Polish model for the first time. Further, in the same context, the issue of restitution of monuments unlawfully taken away from the state with legal rights to them, as well as novel solution adopted in that respect by the European Union and subsequently incorporated universally as UNIDROIT have been mentioned. It is also stressed that the Polish Act has incorporated the full scope of the solutions developed by the European Commission. Finally, the valuable initiative proposed by UNESCO and aimed at protection of monuments has been presented, and namely the creation of the „World Heritage List”, and related to it „World Heritage in Danger List” . While the former is mainly of a prestigious character, the latter offers concrete financial support necessary for rescuing selected monuments all over the world, and therefore also in Poland.Item PRAWO PRACOWNIKA DO ZAKŁADOWEGO ZASOBU WIEDZY W SFERZE BHP(Wydział Prawa i Administracji UAM, 2007) Jankowiak, JarosławThe author’s deliberations presented in the paper concern the question whether, de lege lata, by way of legal interpretation, it is possible to reconstruct from a Polish legal text on safety and health at work the comprehensive right of an employee to undertakings knowledge in that sphere place. It is then claimed that the said legal text doe not express such a legal modality being an individual right (and not a collective or public one) o f an employee. Having analysed the constitutional regulations, the treaty (conventional) provisions, and the provisions of the statutes and ordinances, the author concludes that this right may be derived from the constitutional regulation, by reference to the argument of compliance o f that provision with the contemporary legal culture ot the world in the area o f safety and health at work.Item SPRAWOZDANIA I INFORMACJE. Further he claims that this principle, the nature of which pertains to the political system of the state, orientates the whole process of the state influencing the economy, and constitutes the state’s objective, i.e. the state’s intervention in the economy in a situation when the fundamental values, including social justice, are at risk. This principle is addressed to organs of public administration as well as the legislative and judiciary organs of the state, which carry out the directives which, depending on the functions they perform, arise for them from the principle o f a social justice state, taking into account other principles, such as the principle of a democratic state of law, of subsidiarity, proportionality and economic rights and freedoms. Implementation of the principle of a social justice state is realised in a number of ways and through different means engaged to achieve integration of the organs of public authorities into the economy, as well as through the states direct economic activity, having regard to the limitations arising from the constitutionally protected individual rights and liberties.Item „OGÓLNA TEORIA”, KEYNESIZM NIERÓWNOWAGI A WSPÓŁCZESNE PROGRAMY BADAWCZE(Wydział Prawa i Administracji UAM, 2007) Bludnik, IzabelaAccording to the interpretation presented by disequilibrium Keynesianism, Keynes was not interested in the state o f equilibrium, but his main purpose was rejection of the perfect Walrasian model. Hence, unemployment and insufficient demand started to be perceived as disequilibrium phenomena. The main reason for that was attached to the problems of dissemination of credible information. Imperfect and costly knowledge in a large decentralised system leads to discrepancies between the effective and the notional demand. As a result, it is the quantities rather than prices that adjust. Focused studies o f solid microfoundations of the analysed aggregate problems gave an impulse to New Keynesianism, while imperfect information, coordination failures and quantity adjustments faced by individual agents became a cornerstone of the New Keynesian research agenda.Item SPRAWOZDANIA I INFORMACJE. Further in the text, the solutions adopted in the Polish Public Information Access Act are presented and an attempt o f their evaluation is offered. Such an evaluation, however, cannot be made without referring to the basic issue, i.e. the choice of the model of administrative control over the right to information contained in public records. Thus, the paper presents arguments in favour o f establishing a specialised entity authorised to manage the access to public information in Poland, and arguments against such a proposal. This seems rather necessary because the traditional idea and practice of offenders rehabilitation are in crisis, and the Polish penitentiary thought is in sure stagnation. Hence an urgent need to revive it by offering some new paradigms. In the author’s opinion, one o f the possible directions, to some extent alternative to traditional rehabilitation, is social work. This kind of influence on criminals is then analysed in two planes: that of good practice and as a test of its generalization to the level of a scientific theory. Basing on his earlier publications, the author then extends his vision of judicial social work by reference to the theory of social control proposed by T. Hirschi. According to a simple economic model of rational behaviour, it is expected that the propensity to commit criminal activities should be negatively related to the risk of deterrence. Potential presence of higher risk profiles for certain population segments (urban groups, males, foreigners, unemployed, young people, uneducated, and low-income earners) are controlled for. Panel data aggregated to sub-regional levels and observed annually for the years 2003 to 2005 are applied. Controls for endogeneity among criminal activity level and risk of deterrence, intra-regional correlation, inter-temporal heterogeneity and spatial spillover are exerted.
