Item Stymulowanie rozwoju południowych Włoch jako przykład interwencji państwa w odniesieniu do regionów opóźnionych(Wydział Prawa i Administracji UAM, 1994) Klamut, Mirosława; Gogolewska, JadwigaThe paper focuses on the Italian state's regulatory influence on regional development. Particularly the regional policy between 1950 and 1989 is described in great detail. The set of instruments known as extraordinary intervention has never functioned properly, for various reasons: the incompatibility between actions of different governments or their purposes, the absence of co-ordination of locally formulated regional plans, a low degree of concreteness. The role of t he regional structural policy is first described in order to identify its objectives, scope, subjects, and instruments. The regional structural policy is a well-established component of the FRG's economic policy. A lederai state structure necessitates some specific regulations of the problem of relations between objects. The pyramid of objectives adopted within a social market economy defines the objectives of the regional structural policy. These objectives, in turn, determine appropriate instruments. Both theoretical and practical experience indicates that regardless of the extent of the state's economic interventionism, a regional structural policy must be continued.Item Istotne naruszenie zobowiązania jako przesłanka odpowiedzialności kontraktowej w Konwencji Wiedeńskiej(Wydział Prawa i Administracji UAM, 1994) Napierała, JacekThe use of a uniform institution of a "breach of contract" does not rule out the practicability of combining specific sanctions with certain types of breach. In this respect a fundamental breach plays an important role in the Vienna Convention. The article aims at systemizing the problems arising in the practical application of this institution. A fundamental breach is singled out on its basis of its result, namely: (1) the loss of either party's interest; (2) which was unpredictable. The combination of certain sanctions with a qualified form of an infringement to the creditor's interest gives rise to the question about the criterion of such qualification. Four criteria were considered during discussions about the uniform law for contracts of sale. The Convention decided in favour of the degree of dissatisfaction of the creditor's expectations related to performance as the criterion of a "fundamental" breach. The degree of dissatisfaction depends for instance on the possibility of removing a defect from delivered goods. The last opinion can be proven by describing the fundamental nature of breach without making reference to provisions relating to sanctions in case of such breach. Institutions of Polish law having their counterparts in the Convention are presented in the conclusion.Item Nurt instytucjonalny we współczesnej myśli ekonomicznej(Wydział Prawa i Administracji UAM, 1994) Ratajczak, MarekThe paper deals with a description of institutionalism and focuses on its contemporary form - the so-called neo-institutionalism. The main three parts relate to: (1) characteristics and criticism of neo-institutionalism; (2) the relationship between neo-institutionalism and the mainstream economics; (3) the relationship between neo-institutionalism and the new institutional economics. In the authors opinion neither neo-institutionalism nor the new institutional economics should be seen as alternatives to the mainstream economics. Instead, an attempt should be made to combine their strengths and achievements in order to provide a better explantation of the market economy mechanisms In conclusion, attention is paid to the applicability of neo-institutionalism and of the new institutional economics to the analysis of transition from a centrally planned to a free market economy. Many of the related phenomena (inertia and slow evolution of institutions as obstacles to the economic transition) are best explicable on the level of institutional analysis. A relationship is identified between the methods of situating junctions of a logistic network and the spatial shape of such junctions. Several novelties are noticed in comparison with the Code currently in force. The chapter on crimes against life and body is placed differently. Provisions on homicide, especially infanticide and murder, are drafted specifically and not synthetically. The penal law protection of an unborn child including a child capable of independent survival is given a new shape. The proposed solutions are presented against the background of the law in force and their soundness is discussed. Problems arising in this connection and concerning legal qualification of acts as various types of homicide are also considered.Item Dylematy ekologizacji rolnictwa w Polsce(Wydział Prawa i Administracji UAM, 1994) Łuczka-Bakuła, WładysławaThe article deals with various economic aspects of ecological agriculture, ranging from its background in Western Europe to supply and demand conditions in Poland. The hitherto prevalent view has been one-sided in handling problems of ecological agriculture, hence an enrichment with economic aspects is necessary. The development of ecological agriculture in Western Europe has been for a long time on the margin of economic life. Its recent dynamization has been taking place in a situation where on the one hand traditional agriculture secures enough cheap standard food, on the other hand it scarcely satisfies the demand for quality food. Simultaneously, traditional agriculture produces a food surplus affecting state budgets, which makes ecological agriculture a viable method of controlling overproduction. The problem of ecological agriculture in Poland boils down to the question which of its structural characteristics can be viewed as favourable or unfavourable from the point of view of the problems facing the Polish economy today. Until the overproduction problem and the consumer demand for ecological food can be researched, it is undesirable to copy mechanically the western experience in ecological agriculture.Item Społeczne następstwa konkurencji w ubezpieczeniach zdrowotnych(Wydział Prawa i Administracji UAM, 1994) Chojnacki, MarianDifferent versions of market economy entail stratification of the insured population corresponding to differences in the socio-economic status. Despite the different economic and welfare systems in the U.S. and Germany, common features were found with regard to the segregation of insured and uninsured respondents in both countries. Firstly, economic inequality causes an unequal access to certain insurance standards. Consequently, however, it is an unequal access to medical care that bringe about health handicaps for those unable to obtain better services. The existence of a social group of less healthy, poor and inadequately insured is going to be a challenge for the social policy also in our country. A specific problem is the distribution of health risks of an insurance company's clients among various subjects. Therefore specific Problems arise in fixing tariffs for such services and thoughtful regulations are necessary for an appropriate organization of t h e market.Item Polska a Wspólnota Europejska - uwagi o współpracy i integracji gospodarczej(Wydział Prawa i Administracji UAM, 1994) Winiarski, BolesławThe article outlines the problems and difficulties arising in the process of co-operation and gradual economic integration of Poland and the European Community (or, currently: the European Union). These difficulties are related on the one hand to the maintaining by the EC of various trade barriers with regard to post-socialist countries, on the other hand to the incompatibility of Poland's economy with the EC standards, particularly those concerning the quality of products. The transitional period provided for in the Association Agreement is therefore very useful for broadly planned adjustment programs. The necessary strengthening of the competitiveness of Poland's economy may be obtained through an active industrial policy, as well as a subtle yet effective protection of the local market. The great challenge of the integration of the formerly separated parts of Europe can be met more easily with the help of a closer regional co-operation between the so-called Visegrad countries. Their current rivalry should thus be superseded by the co-ordination of actions aiming at integration with the EC.
