Item Elektroniczne budżety obywatelskie w największych miastach Polski(Wydawnictwo Naukowe UAM, 2016) Matusiak, JustynaElectronic participatory budgeting is becoming an important element of social consultations. The legal ground for its operation at the municipal level is provided in Article 5a of the Act of municipal self-government. The organisation of participatory budgeting is a manifestation of direct democracy that allows citizens to express their approval or disapproval of the actions taken by local authorities. It also reflects the level of citizen e-participation in public life. In Poland e-participation is still at a developing stage and therefore needs to be further researched in comparative studies. This article is an attempt to determine whether in the largest cities in Poland e-participation is used in voting on city budgets and if the answer if in the affirmative, which e-tools are available and used, and to what extent. By analysing relevant and applicable legislation, the possibility of electronic filing of projects as well as the number of e-voters have been researched. All budgeting processes taking place in Warszawa, Kraków, Łódź, Wrocław and Poznań since 2015, when the project started, have been examined. Citizen participatory budgeting as such started in Poland in 2011. However, the largest cities continue to encounter difficulties in their proper implementation. Resorting to electronic tools has not helped much, what is more, some municipal bodies, for the sake of least complexity, sometimes resign even from the use of electronic signature. The main focus is put on the innovative potential which will become available in the electricity market once the energy system in Poland is based on smart grids and when energy consumers are billed with the use of smart metering. In the first part of the paper, the concept of a smart grid and its innovative characteristics is presented. The main emphasis is put on cooperation between businesses operating in the energy sector and those in the IT sector. This innovative approach is indirectly determined by numerous EU legislative acts which set out trends and directions of development of the energy transmission system. The second part addresses the legal requirements of implementing a smart grid concept and looks at how this issue is understood the Polish regulatory authority and others bodies of central administration responsible for the energy sector. The paper ends with an identification of potential benefits arising from the implementation of smart grids and smart metering, which include: renewable energy resources, energy efficiency, energy security and the mechanism of demand side management. Selznick and Ph. Nonet. In the study Law and Society in Transition. Towards Responsive Law they distinguished three stages of evolution of legal systems: repressive, autonomous and responsive. The focus of the article is on the institution of the official interpretation of tax law, because an analysis of the transformation of the legal system allows to capture trends that are present in the development of its individual institutions as well as social relationships among its recipients. By indicating the evolution of official in terpretations of tax law in its two basic functions – those of informing and those of guaranteeing (protective) – the authors point to a wider context of the development of tax law to show whether and how changes in the normative regulation of official interpretations of tax law may affect the shape of the relationship between a tax payer and tax administration, where the perspective of the analysis of demand is the responsiveness of law. An analysis of the regulation of an official interpretation of tax law leads to the conclusion that due to the assigned ratio legis this interpretation must characterise them as corresponding mainly to the autonomous model. At the same time a responsive model of law does not undermine the autonomous model attributes. Thus if we were to accept that the provision of interpretation corresponds to the autonomous model, it would not be possible to note that it also has attributes that make it a responsive model. Irrespective of the fact that there is no element of negotiation, it is based on the interaction between the taxpayer and the tax administration. As part of this interaction, tax administration responds to the reported social need in terms of the ambiguity of law, which de iure – not least because of the possibility of bringing an action against the content of interpretation – takes place in the framework of a communication situation that is free from external coercion.Item Models of liability for the administrative tort sanctioned with fi nancial penalties on the example of selected European countries(Wydawnictwo Naukowe UAM, 2016) Staniszewska, LucynaPrzedmiotem niniejszego artykułu są modele odpowiedzialności administracyjnej za naruszenia prawa publicznego w wybranych państwach europejskich, tj. Austrii, Czechach, Francji, Niemczech i Wielkiej Brytanii. We Francji i Wielkiej Brytanii wpływ na model odpowiedzialności wywiera orzecznictwo sądowe, natomiast w pozostałych państwach modele te są regulowane prawem stanowionym, jednakże w sposób fragmentaryczny. Niestety, bardzo często prawo stanowione nie zawiera ogólnych regulacji dotyczących kar pieniężnych. Jest to negatywne zjawisko zwłaszcza ze względu na to, że kary administracyjne są istotnymi instrumentami zapewnienia wykonania aktów administracyjnych oraz normatywnych. Podjęcie problematyki sankcji administracyjnych jest spowodowane wyraźną tendencją prawodawców w wielu państwach Unii Europejskiej do stanowienia kolejnych deliktów administracyjnych i kar za nie wymierzanych. Ustawodawca często jednak czyni to bez głębszego zastanowienia i zagadnienie to reguluje tak, by wymierzane kary realizowały interes publiczny i były zgodne z międzynarodowymi zasadami ochrony praw człowieka. Biorąc pod uwagę ciężar gatunkowy administracyjnych sankcji, zwłaszcza kar pieniężnych, należy wskazać, że negatywnym aspektem jest niedostatek regulacji prawnych w tym zakresie. Stosowaniu sankcji administracyjnych towarzyszą poważne dylematy związane z możliwością ich wymierzania z pominięciem zasady trójpodziału władzy, a także z gwarancjami charakterystycznymi dla spraw karnych. Pomimo licznych uwarunkowań administracyjnoprawnych, wpływających na cha-rakter prawny instytucji sankcji administracyjnych, charakteryzują się one cechami właściwymi dla spraw karnych. Złożoność ich konstrukcji staje się jednak w pełni widoczna dopiero w obliczu analizy różnorodnych modeli ich stosowania. Żaden z nich nie ujmuje jednakże problemu sankcji administracyjnych kompleksowo w taki sposób, by mógł on posłużyć przykładem dla innych porządków prawnych.Autorka opracowania postuluje przygotowanie ogólnych regulacji zasad stosowania sankcji administracyjnych w poszczególnych państwach europejskich w celu pełnej realizacji zasady ochrony praw człowieka i obywatela w sprawach represyjnych.Item O stopniach naukowych w Polsce Ludowej. Niższe stopnie naukowe(Wydawnictwo Naukowe UAM, 2016) Wojtczak, KrystynaIn the period researched in this article (1947–1990) the principles of awarding academic degrees were far from stable (or uniform). What is more, difference between individual degrees were of multiple character. In the initial years shortly after the Polish People’s Republic was formed, a lower academic degree was award ed to every higher school graduate. From 1951on this term referred to degrees awarded to science candidates, and as of 1958 to a degree of a doctor. Secondly, the requirements needed to be satisfied in order to qualify for individual degrees differed and were changing. Thirdly, on and off there were instances where ex emptions were made from the generally binding principles governing awarding of academic degrees, especially in the case of a science candidate and a doctor. Those exemptions, or exceptional treatment, was justified by a reference to an exceptional case. Fourthly, lower academic degrees could not always be obtained in every discipline, and the list of the discipline that qualified candidates for a degree was neither closed nor stable. Fifthly, the rights granted to scientific councils of institutions of higher education, and later to scientific councils of units operating within the Polish Academy of Sciences as well, were also changing, mostly to meet the conditions and requirements which those unites were obliged to fulfil. Sixthly, depending on the role and position of other bodies or organs involved in the process (the minister competent for schools of higher education, the Main Council of Higher Education, or the Central Qualifications Committee) their say and role was also changing. For the sake of a certain simplification, it may be stated that solutions adopted as a result of the reforms of 1947 and 1951were comparable, while those implemented in subsequent years, particularly by acts on higher education of 1958, 1982 and 1985 and the act of 1965 on academic degrees and scientific titles as later amended, differed considerably from earlier solutions. The assessment, from a legal point of view, of the conditions of awarding lower academic degrees in the period researched would, however, have been incom- plete if the organisation of doctoral studies as well as the manner of their delivery leading to the preparation and submission of a doctoral dissertation by a degree candidate, had been examined as well. Teoretycznym uzasadnieniem występowania takich tendencji jest założenie, że człowiek zwykle działa zgodnie z gotowymi schematami, zaakceptowanymi przez zbiorowość, które obejmują normy (reguły) należące do trzech podstawowych kategorii: (1) reguły dotyczące zdobywania dóbr za pomocą wymiany towarowo-pieniężnej, (2) reguły odnoszące się do pozyskiwania dóbr poprzez powołanie się na uprawnienia wynikające z przynależności do zbiorowości oraz (3) normy prawne, których rolą jest ochrona i upowszechnienie reguł należących do dwóch pierwszych kategorii. W rezultacie popyt na sposoby zaspokajania potrzeb determinowany określonymi regułami zwiększa podaż norm prawnych związanych z określonym zagadnieniem społeczno-gospodarczym. Skutkuje to pojawianiem się tendencji długookresowych w tworzeniu źródeł prawa, które można badać metodami empirycznymi, przedstawionymi w niniejszym artykule. W opracowaniu prezentowane są wyniki analiz dotyczących jednego z pytań badawczych, odnoszącego się do ważnego problemu społeczeństwa i gospodarki, jakim jest kwestia, czy regulacja ułatwia ocenę szans na osiągnięcie zakładanego celu gospodarczego, czy służy wzmacnianiu poczucia pewności obrotu gospodarczego, zmniejszeniu ryzyka niepowodzenia w działalności gospodarczej. We wnioskach zawarta jest teza, że zmniejszanie ryzyka przedsiębiorcy (przez regulacje bezpośrednie) jako trend w prawodawstwie systematycznie się umacnia. Analiza danych z badań pozwala zauważyć delikatny długoterminowy trend wzrostowy w ustawo-dawstwie, jeśli chodzi o zmniejszanie ryzyka gospodarowania przez przedsiębiorcę (w postaci regulacji bezpośrednio dotyczących tej tematyki).
