INABILITY OF THE PRESIDENT OF THE REPUBLIC OF POLAND TO DISCHARGE HIS DUTIES UNDER THE PROVISIONS OF THE CONSTITUTION

Abstract

W świetle Konstytucji RP z 1997 r., jeśli Prezydent przejściowo nie może sprawować urzędu, zawiadamia o tym Marszałka Sejmu, który tymczasowo przejmuje jego obowiązki. Jeśli Prezydent nie jest w stanie dokonać stosownego zawiadomienia, Trybunał Konstytucyjny, na wniosek Marszałka Sejmu, rozstrzyga o stwierdzeniu przeszkody w sprawowaniu urzędu. Marszałek Sejmu tymczasowo – do czasu wyboru nowego Prezydenta – wykonuje obowiązki głowy państwa także w przypadku uznania przez Zgromadzenie Narodowe trwałej niezdolności Prezydenta do sprawowania urzędu ze względu na stan zdrowia. W opracowaniu poddano analizie potencjalne problemy, jakie mogą powstać w odniesieniu do konstytucyjnej regulacji niemożności sprawowania urzędu przez Prezydenta. Szczególnie poważne kontrowersje mogą dotyczyć rozumienia „przejściowej niemożności” i odróżnienia jej od „trwałej niezdolności”. Konstytucja nie udziela też odpowiedzi na pytanie, jakie działania prawne należy podjąć w sytuacji, gdy trwała niezdolność Prezydenta do wykonywania jego obowiązków wynika z przyczyn innych niż stan zdrowia. Ponadto zwrócono uwagę na liczne mankamenty uregulowań zawartych w ustawie o Trybunale Konstytucyjnym, dotyczących postępowania w sprawie stwierdzenia przeszkody w sprawowaniu urzędu przez Prezydenta. Prowadzi to do wniosku, że w obecnej postaci kształt badanych unormowań prawnych jest dalece niewystarczający do złagodzenia potencjalnego kryzysu politycznego wynikającego z opróżnienia urzędu głowy państwa. Pożądane wydaje się podjęcie interwencji legislacyjnej w tym względzie.
*In light of the Constitution of the Republic of Poland of 1997, if the President of the Republic of Poland is for some time unable to discharge the powers of his office, his duties are then temporarily assumed by the Marshal of the Sejm. If the President is not in a position to inform the Marshal of the Sejm about his inability then the Constitutional Tribunal, at the request of the Marshal, determines whether or not there exists an impediment to the exercise of the office by the President. The Marshal of the Sejm temporarily discharges the duties of the head of state when the National Assembly declares the President’s permanent incapacity to exercise the office due to the state of his health. The paper focuses on some potential dilemmas which may arise in relation to the constitutional regulation of the President’s incapacity to continue his duties. Particularly serious controversies may appear over defining ‘temporary inability’ and discerning it from ‘permanent incapacity’. Neither does the Constitution provide the answer to the question what legal measures should be adopted if the President’s permanent incapacity to exercise his office is caused by factors other than the state of his health. Numerous shortcomings of the regulation of the procedure determining an impediment to the exercise of the office by the President provided by The Constitutional Tribunal Act in force are being listed, this leading to the conclusion that the current scope of the legal regulations is highly insufficient to ease a potential political conflict resulting from the office of the head of state becoming vacant. Thus there seems to be a need for some legislative intervention.
