THE CLARIFYING AND THE DERIVATIVE ASPECT IN THE INTEGRATION OF POLISH THEORIES OF LEGAL INTERPRETATION
Abstract
Artykuł poświęcono przybliżeniu rzeczywistych relacji między klasyfikacyjnością a derywacyjnością teorii wykładni, ujawnia w istocie ich znaczną zbieżność. Zbieżność ta może stanowić realną podstawę kształtowania się ogólnej zintegrowanej koncepcji wykładni (po odrzuceniu niedającego się współcześnie zaakceptować założenia o możliwości bezpośredniego rozumienia tekstów prawnych).
Opracowanie jest zarysem pierwszego etapu programu budowania ogólnej zintegrowanej teorii wykładni prawa, który następnie wymagać będzie również uwzględnienia problemów interpretacyjnych w kontekście integrującej się europejskiej kultury prawnej.
*The paper aims to approximate the relations between the clarifying and derivative characteristic of the theory of interpretation of law and shows that both features are significantly similar. This similarity may then constitute a realistic basis for the shaping of a general integrated conception of interpretation, provided that the assumption that direct understanding of legal texts is possible is rejected as being inacceptable in the contemporary world. The paper is an outline of the first stage of a project designed to develop a general integrated conception of legal interpretation, At that stage it will also be necessary to account for the problems with legal interpretation in the context of the integrating European legal culture.
