Legal aspects of agricultural biomass collection and energy use
Abstract
W pracy poruszono problematykę pozyskiwania i wykorzystania na cele energetyczne biomasy stałej i biogazu z materii pochodzenia rolniczego w świetle obowiązujących i projektowanych krajowych i unijnych regulacji prawnych. Praca zawiera elementy prawnoporównawcze – oprócz polskiego uwzględnione zostało prawodawstwo niemieckie, francuskie i włoskie. Celem pracy jest odpowiedź na pytanie w jakim stopniu regulacja prawna służy wzrostowi pozyskiwania i wykorzystania biomasy rolniczej na cele energetyczne przy zachowaniu wymogów bezpieczeństwa żywnościowego i ochrony środowiska. Analizie poddane zostały prawne gwarancje zgodności z kryteriami zrównoważonego rozwoju wyznaczonymi z dyrketywie 2009/28/WE, obecne i projektowane prawne systemy wsparcia produkcji energii i gazu w rozproszonych instalacjach zasilanych biomasą rolniczą oraz status prawny działalności polegającej na pozyskiwaniu i wykorzystaniu biomasy rolniczej na cele energetyczne w ramach gospodarstwa rolnego.
The dissertation deals with the questions of agricultural solid and gaseous biomass collection and use for energy purposes in the light of current and future legal regulations at the level of the European Union and member states. It includes comparative analysis of Polish, German, French and Italian legislations. The aim of the research was to estimate the extent to which the regulations secure the growth of agricultural biomass energy production without compromising on food security and environmental protection requirements. Legal methods to ensure compliance with the sustainability criteria as set out in 2009/28/EC directive, current and drafted support mechanisms for bioenergy production in the decentralised units and legal status of the activity consisting on agricultural biomass collection and farm-based energy use have been analysed. The work outlines the key sector specific legal regimes allowing for sustainable bioenergy production.
