THE CONCEPT OF POSSESSING CHILD PORNOGRAPHY REFERRED TO
Abstract
Artykuł dotyczy wykładni znamienia ustawowego „posiadanie” w odniesieniu do pornografii dziecięcej w formie cyfrowej. Autor przedstawia różnice w interpretowaniu pojęcia na gruncie prawa cywilnego i karnego, orzeczenia sądów angielskich i amerykańskich dotyczące tego zagadnienia oraz dokonuje próby wykładni pojęcia, uwzględniając specyfikę danych informatycznych i systemów informatycznych. Dokonana analiza wskazuje, że nadawanie pojęciu posiadania szerokiego znaczenia może w przypadku pornografii dziecięcej w formie cyfrowej prowadzić do rezultatów trudnych do zaakceptowania. Dotyczy to w szczególności danych usuniętych.
The article discusses the meaning of ‘‘possession’’ as an element of crime in relation to child pornography in a digital form. The author first analyses the differences in the interpretation of the term in civil and criminal law and refers to different decisions of English and American courts concerning the matter. Next, he attempts to interpret the term taking into account the specific features of computer data and information systems. This brings him to the conclusion that in the case of digital child pornography, if a certain term is given a broad meaning, the result may be hard to accept. This concerns in particular deleted computer data.
