Presupozycje ontologiczne tekstu prawnego to twierdzenia o określonej wartości logicznej, informujące o rzeczywistości społecznej założonej przez prawodawcę. Twierdzenia te mają charakter akontekstualny w tym sensie, że ich odtworzenie nie wymaga odwoływania się do ich kontekstu. Artykuł składa się z czterech części. W pierwszej omawiam podstawowe założenia pragmatyki języka, w drugiej – szczególne właściwości presupozycji ontologicznych tekstu prawnego, a w trzeciej – podstawowe założenia koncepcji ontologii rzeczywistości społecznej J. Searle’a oraz instytucjonalnego porządku normatywnego N. MacCormicka. W czwartej części na podstawie analizy dwóch przepisów prawnych argumentuję na rzecz normatywno-instytucjonalnego charakteru rzeczywistości społecznej presuponowanej w tekście prawnym.The aim of the paper is to answer the question whether ontological presuppositions may be useful in analysing a legal text. In the author’s opinion they may. Ontological presuppositions are statements of a certain logical value which indicate a given state of affairs, which inform that the legislator prefers a certain state of affairs, a certain event or a certain conduct. Those statements are of an a-contextual character in the sense that in order to reconstruct them it is not necessary to refer to the context of a given expression. As it is shown in the paper, despite many views to the contrary, ontological presuppositions may constitute an independent source of knowledge of the ontological assumptions of the drafter of a legal text, irrespective of its extralinguistic context. Based on J. Searle’s theory of social ontology and N.
