Następnie zostały przeanalizowane, dotyczące ściśle tematu pracy, kwestie uznania zagranicznego postępowania upadłościowego i jego przedmiotu, odmowy uznania zagranicznego postępowania upadłościowego, skutków uznania zagranicznych postępowań upadłościowych, uprawnień zarządcy do podejmowania działań na terytorium Państwa Członkowskiego, w którym nastąpiło uznanie. Wobec faktu, że skutki uznania postępowania upadłościowego w innych Państwach Członkowskich są takie, jak określa prawo państwa wszczęcia postępowania upadłościowego, Autorka zajęła się także zagadnieniem prawa właściwego dla wszczęcia i prowadzenia postępowania upadłościowego i jego skutków.The main dissertation topic is introduced by general considerations on the Council Regulation (EC) No 1346/2000 of 29 May 2000 on insolvency proceedings: its historical background, aims, scope, structure, relationship to national law and Conventions, as well as the question of national jurisdiction in insolvency matters. Subsequently, the following aspects closely related to the topic are analyzed: recognition of the foreign insolvency proceedings and of their subject, non-recognition of foreign insolvency proceedings, the effects of recognition of foreign insolvency proceedings and the powers of the liquidator to take action within the territory of the Member State which recognised the proceedings. In view of the fact that the effects of the recognition of the insolvency proceedings in any other Member State are as under this law of the State of the opening of proceedings, the Author also takes up the issue of the law applicable to the opening and conduct of the insolvency proceedings, including their effects.polinfo:eu-repo/semantics/restrictedAccessDysertacja
