Women’s rights in the Islamic Emirate of Afghanistan
Abstract
Prezentowany artykuł poświęcony jest swoistej analizie zmian, jakie zachodziły w postrzeganiu statusu kobiet w Afganistanie. Państwo to, współcześnie nazywane także Islamskim Emiratem Afganistanu, jest obszarem na terenie którego poziom nierówności i dyskryminacji płciowej należy do jednych z najwyższych na świecie. Początków afgańskiej państwowości należy upatrywać już w XVIII wieku. Na przestrzeni lat lokalna społeczność stawała w obliczu licznych konfliktów zbrojnych, których podłoża należy szukać zarówno w interwencjach państw trzecich, jak i problemach wewnętrznych. Wśród nich wymienić można chociażby konflikty etniczne, czy też skrajny ekstremizm
religijny.Pierwsza część artykułu zawiera analizę pozycji kobiet w świetle islamu oraz tradycji bliskowschodnich. Autorka wskazuje przy tym na dwa główne determinanty, które w sposób realny oraz znaczący
oddziałują na zakres przyznawanych jednostce praw. Zalicza do nich kolejno: religię – jako czynnik kształtujący mentalność poszczególnych grup, jak również patriarchalny model społeczeństwa, determinowany przez sferę fizyczną, psychiczną, a także duchową człowieka.W drugiej części autorka opisuje zmiany społeczno-kulturowe, jakie zaszły w 2021 roku, tj. po ponownym przejęciu władzy przez Talibów. Odwołuje się przy tym do ustaw oraz rozporządzeń, jakie zostały wprowadzone w Islamskim Emiracie Arabskim. Trzecia część zawiera odniesienia do założeń prawa międzynarodowego oraz wszelkich innych aktów, obejmujących swą tematyką problematykę dyskryminacji kobiet oraz pozostałych grup defaworyzowanych w świetle prawa krajowego. Celem lepszego objaśnienia danego zagadnienia, przedstawiona zostaje także definicja terminu „dyskryminacja”. W ostatniej części pracy autorka zawarła charakterystykę aktualnej pozycji kobiet w Afganistanie, przedstawiając przy tym swoje spostrzeżenia na temat dynamiki zmian zachodzących w mentalności tamtejszej społeczności.
The article is devoted to the specific analysis of the changes that have taken place in the perception of the status of women in Afghanistan. The state, also known as the Islamic Emirate of Afghanistan, is an area where the level of gender inequality and discrimination is one of the highest in the world. The origins of Afghan statehood date back to the eighteenth century. Over the years, the local community has faced numerous armed conflicts, the basis of which can be found both in the interventions of third countries and in internal problems. These include, for example, ethnic conflicts or extreme religious extremism.The first part of this article contains the analysis of the position of women in the light of Islam and Middle Eastern traditions. The author points to two main determinants that have a real and significant impact on the scope of the rights granted to an individual. She points them out consecutively: religion – as a factor shaping the mentality of each group, as well as the patriarchal model of society, determined by the physical, mental and spiritual spheres of a human being. In the second part, the author describes the socio-cultural changes that took place in 2021, i.e. after the Taliban took power again. It refers to the laws and regulations that were introduced in the Islamic Emirate of Afghanistan. The third part contains references to the assumptions of international law and all other acts that deal with the issue of discrimination against women and other disadvantaged groups under national law. To better explain the issue, a definition of the term “discrimination” is also provided. In the last part of the paper, the author describes the current position of women in Afghanistan and at the same time, she presents her observations on the rate of change in the mentality of the local community.
