The article presents recent developments in the tort law concerning the protection
of the interests of the unborn and/or the parents of the unborn and attempts
to reconstruct basic notions and definitions appearing in the court decisions and legal writings dealing with the said branch of tort law. Five types of delicts
have been described: preconception torts, prenatal torts, wrongful life, wrongful
birth and wrongful death. Included are the remarks on the origin and evolution of
of each of the delicts as well as on their enforcement in the judicial decisions
throughout the fifty states.
