Item KARA ZA PRZESTĘPSTWA POPEŁNIONE W FORMACH STADIALNYCH(Wydział Prawa i Administracji UAM, 1998) Kunze, EugeniuszPolish penal law foresees responsibility for an attempt at forbidden act and sometimes also for preparation for such a crime. The literature is dominated with objectivist opinion that punishability of behaviour preceding a commitment is justified in case where a menace for some legal good had place. New Polish Penal Code has adopted in its article 14 a principle that a court sentences an attempt within the limits of threat o f punishment foreseen for given crime. However the standpoint of the Supreme Court is that the punishment sentenced for an attempt to commit a crime should be, as a rule, lower than for a crime committed. The Author presents a review of penal law dispositions being in force presently and concerning “a preparation for a crime” and gives his commentaries on particular sentences issued in courts in this respect.Item Karalne postacie przygotowania przestępstwa w polskim prawie karnym(Wydział Prawa i Administracji UAM, 1990) Kunze, EugeniuszPolish Penal Code considers crime preparation to be a form of a criminal offence. Art. 14 § 1 gives basis for distinguishing five detailed forms of crime preparation, and one general clause which states as follows: „or takes up other similar activities". The five detailed forms include the following: purchase of means, adjustement of means, gathering information, drawing up a plan of action, and making contact with another person. The preparation of a crime is punishable only in the cases stated in the Penal Code and concerns those offences which threaten collective goods important for social relations. Crime preparations is not punishable when the offender has voluntarily given it up.Item Pojęcie pojazdu mechanicznego w polskim prawie karnym(Wydział Prawa i Administracji UAM, 1978) Kunze, EugeniuszAu début de l'article on a fait quelques remarques sur le thème de la notion générale du véhicule. Ensuite on a présenté l'histoire de la notion „véhicule mécanique" dans la législation, dans la littérature du droit pénal et dans la jurisprudence de la Cour Suprême. Puis — on a concentré l'attention sur: a) les diréctives de l'administration de la justice et de la pratique judiciaire dans les affaires concernant les infractions aux lois de route du 28 février 1975; b) les dispositions de la convention sur la circulation de route; c) les dispositions de l'entente européenne suppléant la convention susmentionnée. A l'adresse des directives usmentionnées de la Cour Suprême on a fait quelques remarques (p. 7 et 8). A la fin on a proposé une différente de la Cour Suprême du véhicule mécanique aux termes des dispositions pénales.Item Przygotowanie przestępstwa w jugosłowiańskim prawie karnym(Wydział Prawa i Administracji UAM, 1983) Kunze, EugeniuszThe new penal code of Yougoslavia of 1976 provides in art. 18 of its general part, apart of interpretational directions for understandinig the term of preparation, that a preparation for a crime is amenable to penalty only when it is explicitely provided by law. Thus preparation, as a rule, is not subject to penalty. The exceptions to the rule are described in the code, i.e. crimes, preparation of which is punishable. A general function of the institution of preparation is creating conditions capacitating or facilitating commiting a desired crime. Preparational actions being a subject to penalty can be understood in a dual way: as a phase of a defined criminal act or as a separate, self-contained crime. A voluntary desistance from preparation involves a possibility of release from inflicting a punishment.
