Item DOBROWOLNE UBEZPIECZENIE ZDROWOTNE NA TLE ROZWIĄZAŃ PRZYJĘTYCH W SYSTEMACH WYBRANYCH PAŃSTW(Wydział Prawa i Administracji UAM, 2002) Lach, Daniel ErykThe common health insurance system imposes a duty of insuring a number of varied entities. However, in the method of listing entities that are obliged to take out insurance some social groups were left out. This was certainly the intention o f the legislator because although the insurance is called „common”, health insurance originates mainly from workers’ insurance, addressed primarily to impecunious hired workers. With a view to encompassing more and more social groups with the benevolence of health insurance, the legislator has been expanding the list o f entities obliged to take out health insurance, granting all the others the right for voluntary insurance. This article, whose subject has not yet been dealt with in Polish literature, attempts to evaluate the Common Health Insurance Act of 6th February 1997, which allows the possibility of voluntary health insurance. The author’s appraisal of the legislation is preceded by an account of relevant regulations in Germany, Austria, and Great Britain, all fully representative of the different types of health insurance systems.Item Przetwarzanie i ochrona danych dotyczących zdrowia przez organizatora systemu opieki zdrowotnej(Wydawnictwo Naukowe UAM, 2020) Lach, Daniel ErykThe protection of individuals regarding to the processing of personal data is one of the fundamental rights. The General Data Protection Regulation (GDPR) lays down rules relating to the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data. Data concerning health is one of the areas the GDPR defines as special personal data, the so-called sensitive data. With regard to these data, the GDPR allows their processing only on an exceptional basis, in certain situations. According to Art. 6 sec. 1 let. e GDPR and art. 9 sec. 2 let. b GDPR, data processing is allowed, inter alia, when such processing is necessary for the purposes of meeting the obligations and exercising specific rights of the controller or of the data subject in the field of mployment and social security and social protection law. In turn, Art. 9 sec. 2 let. h GDPR permits the processing of health data that is necessary for the purposes of providing health or social care or treatment, or for managing health or social care systems and services on the basis of European Union or Member State law. The article discusses the national legal regulations regarding the collection and processing of personal data concerning health in the light of the organization of the health care system and the tasks of the National Health Fund (NFZ) as a placeholder, whose task is only to manage financial resources and conclude health care contracts on its own behalf with independent healthcare providers and their accounting. Against the background of the GDPR, the author discusses the provisions of the acts on health care services financed from public funds and on the information system in health care. Finally, specific regulation regarding the COVID-19 pandemic are presented.Item Refundacja leków a równy dostęp do świadczeń opieki zdrowotnej(Wydział Prawa i Administracji UAM, 2014) Lach, Daniel ErykPrzedmiotem opracowania jest przedstawienie zasad dotyczących refundacji leków ustalonych w ustawie refundacyjnej z 12 maja 2011 r. na tle przepisów ustawy zdrowotnej z 27 sierpnia 2004 r. w kontekście konstytucyjnego obowiązku zapewniania obywatelom równego dostępu do świadczeń opieki zdrowotnej finansowanej ze środków publicznych. This is a very important issue from the point of view of the very concept of health service which seeks to ensure adequate treatment to those who are eligible to receive it, and which (this being a characteristic of a health insurance model) can only be provided by qualified, professional providers of the services. Consequently, there are three subjects active in the process: the insured, the insurance institution and the medical doctor. Such a situation requires a complicated system of buying medical services. This is a group of issues related to the admission of doctors and hospitals to the system, allowing them to participate in it and negotiate the conditions and contracts, as well as a control exercised over the providers of the said services, making sure that the financial resources are effectively and properly utilised. In the author’s opinion the German experience is a good starting position from which Polish solutions of these problems could develop, as proper solutions are necessary for the stability of a comprehensive health insurance system.
