The specificity of that relationship is considered in the light of substantive law from the point of view of limited solidarity and the principle of indiividual liability of the defendants These considerations take into account the characteristics of different kinds of joint participation in civil law proceedings. The analysis of the above has led to a conclusion that joint participation in a dispute between the insurer and the insured is a substantive joint participation based on a common obligation with a partly different factual and legal basis, and in consequence the sentance can be different for either of the defendents.Item Interes publiczny w procesie cywilnym(Wydawnictwo Naukowe UAM, 2013) Mucha, JoannaItem Mediacja w administracji? Uwagi na tle doświadczeń w zakresie mediacji w sprawach cywilnych(Wydawnictwo Naukowe UAM, 2018) Mucha, JoannaItem Postępowania w sprawach dotyczących aktów stanu cywilnego – kompetencja organu administracji publicznej czy sądu powszechnego?(Wydawnictwo Naukowe UAM, 2015) Mucha, JoannaThe Act on vital records currently binding and applicable in Poland, also known as the Law on Births, Marriage and Death Certifi cates, similarly to the solutions of former regulations in this area, provides for two diff erent bodies responsible for matters relating to birth, marriage and death certifi cates. Public administration bodies are responsible for making records of the civil status of a person, and for entering necessary amendments to the content of certifi cates if they are possible to be made by comparing the certifi cate in question with other certifi cates. Common courts of civil law are vested with power to conduct detailed evidentiary proceedings (in order to determine the content of a certifi cate) and proceedings requiring legal intervention (invalidation of a certifi cate if it confi rms an untrue event or otherwise making the necessary amendments/corrections to it). This status quo leads to a conclusion that since civil law courts are competent to perform acts in law that are more complicated than merely recording or amending the content of civil status certifi cates, there are no reasons why they should not as well perform these less complicated acts which are currently vested in administrative bodies. This solution seems be even more recommendable in the light of the fact that courts today keep other registers of a function similar to that of the register of vital statistics. Leaving all matters relating to birth, marriage and death certifi cates within the competence of civil courts would be also advisable because it would add to such legal transactions a status of even greater certainty and uniformity. It would also take off the burden of having sometimes to approach two diff erent bodies.Item Realizacja uprawnień dzierżawcy gruntów rolnych w razie zmniejszenia przychodu z przedmiotu dzierżawy (wybrane zagadnienia)(Wydawnictwo Naukowe UAM, 2010) Mucha, Joanna; Suchoń, AnetaThe aim of the article was an attempt at the solution of problems connected with the realisation of rights of farmland lessees in case income from the subject of lease is reduced due to adverse weather conditions. An analysis was conducted concerning the institution of rent reduction based on art. 700 of the Civil Code and the problem of changes in rent payment terms in accordance with the Ordinance of 19 November 2009 on specific premises for the deferment, spreading the payment out into instalments or remittance of dues to the Agricultural Property Agency, as well as legal acts concerning public aid. In conclusion the authors indicate, among other things, that lessees rarely take legal action when the lessor refuses to reduce rent on the basis of art. 700 of the Civil Code. To some extent this results from the imprecise premises justifying rent reduction. Thus the authors propose an extension of legal regulations concerning lease of farmland in terms of rent payment terms and conditions.Item Wykonywanie zarządu nad gospodarstwem rolnym ustanowionego dla zabezpieczenia roszczeń w postępowaniu cywilnym(Wydawnictwo Naukowe UAM, 2013) Głodowski, Włodzimierz; Mucha, JoannaArticle 747 of the Code of Civil Procedure provides for securing monetary claims by way of establishing enforced management of an agricultural holding or its part. The detailed manner of establishing such security is provided in article 7524 of the same Code. The paper is an attempt of a comprehensive analysis of the issue to find solutions to many practical problems. As the analysis shows, although establishing a charge to secure claims seems justified and practical, its form described in the paper raises certain doubts.Item ZASTAW JAKO FORMA ZABEZPIECZENIA WIERZYTELNOŚCI ZWIĄZANYCH Z PROWADZENIEM DZIAŁALNOŚCI ROLNICZEJ(Wydział Prawa i Administracji UAM, 2007) Mucha, Joanna; Suchoń, AnetaThe purpose of the paper is an attempt to answer the following questions: firstly, is the pledge an available and favourable form o f securing receivables related to agricultural production due from a debtor who is an agricultural producer, and, secondly, is the pledge an effective measure of obtaining the benefit for the creditor. Three types of pledges have been analysed: an ordinary pledge regulated by articles 306 - 335 of the civil code, a registered pledge and a statutory pledge related to the agricultural lease (article 701 civil code). The paper presents different issues related to the pledge, including the pledge being a subject and object o f the transaction, and the recovery o f the benefit secured by the pledge. The paper ends with a conclusion that from the point o f view o f both: the pledgor and the pledgee, a registered pledge is undoubtedly a much more advantageous and desirable form of securing receivables than an ordinary pledge. Consequently, postulates requesting modifications of some existing regulations concerning registered pledge act seem to be fully justifiable.
