Item INSTYTUCJONALNE MODELE WDRAŻANIA REGUŁ KONKURENCJI NA ŚWIECIE – WNIOSKI DLA POLSKI(Wydział Prawa i Administracji UAM, 2011) Skoczny, TadeuszThe paper presents preliminary results of an extensive research project on Institutional Models of Competition Law Enforcement Worldwide Conclusions for Poland which is underway at the Centre of Antitrust and Regulatory Studies of the University of Warsaw. On the example of the enforcement systems used in 27 EU Member States, the research hypothesis that there exist 3 main institutional models of public enforcement of competition law: judicial, administrative, and mixed, has been revised and 6 sub-models have been added and characterised within the administrative model. The analysis covers a variety of institutional solutions used to separate the investigative and adjudicative powers of public authorities, the level of their interdependence, their impartiality and expertise. The increasing role of courts as judicial reviewers in the procedure as well as merits of competition cases are also considered.Item REGUŁY OCHRONY KONKURENCJI W SEKTORZE MEDIÓW AUDIOWIZUALNYCH WE WSPÓLNOCIE EUROPEJSKIEJ(Wydział Prawa i Administracji UAM, 2006) Skoczny, TadeuszThe article characterises the new competition protection rules which have been recently applied to the overall audiovisual sector and focuses on actions against horizontal collusion in the sports rights. Also analysed are the most recent Community efforts to ensure the open character of online markets endangered by vertical agreements covering intellectual property rights and the ever-growing impact of merger control on the shape and function of the sector, and in particular the implications of such concentration on the media plurality. The article concludes that the Polish Competition Authority will also have to consider similar problems to those dealt with in the Community and especially the need to keep the access to premium content and proprietary infrastructure open.
