Item PAŃSTWO KONTRAKTUJĄCE: REFORMA SEKTORA PAŃSTWOWEGO W NOWEJ ZELANDII(Wydział Prawa i Administracji UAM, 2005) Swora, MariuszThe paper deals with the organisational and legal aspects of the reform of the public sector in New Zealand. The reform, conducted in the spirit of recommendations of the New Public Management, had substantially transformed the whole government administration, and has become internationally recognised as an example of far reaching and consistent transformations in the public administration, leading to the introduction in it of certain managerial elements. Two aspects of New Zealand’s reforms are discussed in detail: the system of contracting tasks and the transformation of the public service. Possibilities of applying the same solutions in other states are also looked upon.Item PRAWNE PROBLEMY ORGANIZACJI REGIONALNYCH IZB OBRACHUNKOWYCH(Wydział Prawa i Administracji UAM, 2004) Skapski, Michał; Swora, MariuszThe article is an attempt to discuss the structure of regional clearing houses and employment in these bodies. Under the Polish regional clearing houses act the competencies of particular organs of these bodies have been altered repeatedly, which have affected their organisation structure. Additionally, the criteria of applying for employment and the legal grounds of employment in these bodies have been changed many times. The authors are discussing the legitimacy of amendments made and whether the modifications could have affected the operation of regional clearing houses. Another major problem confronted in the article is the status of board members in clearing houses. An analysis has been presented of the evolution and the legal form of employing persons in these positions and well as the criteria for their selection. The motives behind the modifications made are particularly doubtful concerning the different statuses of board members employed fully and partly in regional clearing houses.Item PRZEGLĄD PIŚMIENNICTWA(Wydział Prawa i Administracji UAM, 2009) Swora, MariuszBartłomiej Nowak, Wewnętrzny Rynek Energii w Unii Europejskiej, Warszawa 2009, ss. 302.Item ZNACZENIE KOORDYNACJI I WSPÓŁPRACY W ZAKRESIE ZWALCZANIA KARTELI ANTYKONKURENCYJNYCH W PERSPEKTYWIE MIĘDZYNARODOWEJ(Wydział Prawa i Administracji UAM, 2006) Swora, Mariusz; Sachajko, MarekThe paper deals with international implications of anti-competitive cartel law enforcement. The main issue discussed in the paper is the effectiveness of international legal tools regulating anti-cartel laws enforcement, including, in particular, the leniency programmes. The authors examine the activities of international organisations (especially OECD and ICN) concerning fighting cartels, the US and EU approach to international cooperation within the World Trade Organization, extraterritorial enforcement of the US and EU laws against cartels and the effectiveness of leniency programmes. The authors are skeptical about the possibility of adopting a multilateral antitrust agreement at the WTO, considering particularly US approach. On the other hand, there are legal tools (mainly bilateral agreements) that enable fighting international cartels within a decentralized antitrust law enforcement system. Apart from bilateral agreements, actions against cartels are also taken by certain states through extraterritorial enforcement o f anti - cartel laws. The authors claim that within the system of domestic anti-cartel laws it is necessary to take measures to ensure that anti-cartel sanctions, including those available in criminal law, are effective.
