    KLARYFIKACYJNOŚĆ I DERYWACYJNOŚĆ W INTEGROWANIU POLSKICH TEORII WYKŁADNI PRAWA

    Artykuł poświęcono przybliżeniu rzeczywistych relacji między klasyfikacyjnością a derywacyjnością teorii wykładni, ujawnia w istocie ich znaczną zbieżność. Zbieżność ta może stanowić realną podstawę kształtowania się ogólnej zintegrowanej koncepcji wykładni (po odrzuceniu niedającego się współcześnie zaakceptować założenia o możliwości bezpośredniego rozumienia tekstów prawnych). Opracowanie jest zarysem pierwszego etapu programu budowania ogólnej zintegrowanej teorii wykładni prawa, który następnie wymagać będzie również uwzględnienia problemów interpretacyjnych w kontekście integrującej się europejskiej kultury prawnej.

    Prawo Wspólnoty Europejskiej w aspekcie teoretycznym

    The paper attempts at a brief presentation of theoretical and legal problems which appear in the context of the European Community Law. First, the sovereignty of the Community, the predominance of the Community Law over the laws of member countries and direct application of the Community Law are discussed. Next, the Community Law as a legal system, the application of that system by courts in different member countries and its axiological assumptions have been investigated. The conclusion is that the Community Law is a legal order of a completely new type, and cannot be analysed within the framework of positivist concepts.

    Sposoby uczestniczenia prawników w kulturze

    The author looks at the legal system as a sub-system in the system of cultural norms. In that context the participation of lawyers in culture, as it arises from their specific function in the society, is discussed. The participation of lawyers in culture has been described as a reflexive participation in a certain communication community. Different forms of such participation in different societies have been considered with a view of finding why there is a common and widespread tendency to treat the participation of lawyers in culture only instrumentally. Finally the author postulates a form of a dialogue culture characterised by a critical/innovative approach.

    Tożsamość kulturowa w wykładni i stosowaniu prawa administracyjnego

    The objective of the paper is a rough sketch of the process of development of cultural identity inside of the Polish administrative law. Interpretation of the public law in the country which finished process of transformation after the collapse of communist regime has a lot of difficult moments. Uncertain scopes of constitutional meanings and gaps in the set of legal principles are neutralized by the tendency among lawyers to identify with European legal culture and its values. The author of the text is deeply convinced that there is a need for legal version of the cultural identity based on European values. The paper comprises the concept of such identity in so called narrative version and descriptions of the development of the identity in the Polish judicial application of administrative law.
