DETERMINANTS FOR RULES OF INTERPRETATION OF THE LAW

Abstract

The article presents factors that forejudge the status and contents of rules of normative interpretation of law. The factors are the following: 1) first of all - an appeal to characteristic features of a legal text, and secondarily - 2) an appeal to the ways of real conduct o f interpretators within the process of applying the law, but only within the scope where these ways have been accepted culturally and, in the same time, are not incompatible with indications resulting out of recognition of characteristic features comprised in legal texts (which are, let’s recall it, of absolute priority), 3) adoption of only one and not any other apparatus of notions which could make it possible to reproduce precisely just one and not any other image of the research object, 4) answering the question “when does emerge the situation being object o f interpretation”? The article formulates also some basic rules of interpretation relating to a so-called perceptional phase of an interpretation of law.
