Item Bezpieczeństwo zbiorowe a suwerenność państw(Wydział Prawa i Administracji UAM, 2013) Diallo, Boubacar SidiPrzedmiotem niniejszych rozważań, dotyczących współczesnych stosunków międzynarodowych są z jednej strony suwerenność, a z drugiej – bezpieczeństwo międzynarodowe oraz analiza związku pomiędzy systemem bezpieczeństwa zbiorowego a suwerennością państw w kontekście utrzymania trwałego pokoju i stabilności na świecie. Państwa są tradycyjnie przywiązane do idei suwerenności, jednakże do najbardziej charakterystycznych cech stosunków międzynarodowych naszych czasów należy narastanie różnego rodzaju zagrożenia, zarówno ze strony państwa (np. Iran, Korea Północna), jak i ze strony innych podmiotów (np. Al-Kaida). Bezpieczeństwo i suwerenność to dwa podstawowe pojęcia w literaturze i doktrynie prawnomiędzynarodowej. Dzieje się tak z dwóch powodów: po pierwsze – głównymi aktorami w stosunkach międzynarodowych są państwa, będące suwerennymi podmiotami, a stosunki czy też współpraca między nimi oparte są w zasadzie na poszanowaniu owej suwerenności; po drugie – kwestia bezpieczeństwa jest podstawowym zagadnieniem i warunkiem niezbędnym do wykonywania w pełni suwerennych praw tychże państw oraz zapewnienia współpracy międzynarodowej i rozwoju społeczno-gospodarczego. W artykule tym poruszono również problem konieczności instytucjonalizacji legalnego użycia siły, zarówno w organizacjach ogólnoświatowych, jak i na gruncie struktur regionalnych organizacji międzynarodowych, aby szybko i skutecznie zarządzać sytuacjami i konfliktami zagrażającymi pokojowi i bezpieczeństwu międzynarodowemu. W artykule zwrócono również szczególną uwagę na rolę i miejsce organizacji międzynarodowych w procesie utrzymania pokoju i bezpieczeństwa międzynarodowego, zarówno na poziomie ogólnoświatowym, jak i regionalnym.Item Gender and power: Women’s leadership in the prevention and management of conflicts in Africa(Wydawnictwo Naukowe UAM, 2015) Diallo, Boubacar SidiThis paper describes the role and the place of the woman in African society, with particular focus on the issues of leadership, peace and security. Although women in Africa are more numerous than men, their position is not an enviable one. Thus this work will attempt to describe the causes which prevent the female kind from coming to the fore and being truly equal to men. In order to achieve that aim, one should consider the place of the woman, not only in the traditional society but also in what one sees as the contemporary realities of Africa. The author demonstrates that in most African countries, women had long been excluded from enjoying political rights, and that they have gained such entitlement only recently. Among the reasons which would account for this absence of women in the realm of leadership, one should draw attention to the patriarchal model of authority one acquires as a child and the burden of ancestral tradition which hinges upon the primacy of the male. There are also the additional burdens imposed over time by religions, which had always relegated the woman to the background.The woman has always been associated with the weaker sex, while being the one who gave life. The scope of this paper is limited to the presence of women in the public sphere, that is to say to their leadership in the affairs of peace and security, where women have or may have a certain influence. Certain difficulties encountered by African women with respect to leadership are also experienced by women in other parts of the world. With a few exceptions, all societies have been and continue to be governed by the same principles of exclusion. In Africa, just as everywhere else, there is no need for profound studies to conclude that feminist literature is not particularly abundant. This paper represents an exploration of a subject of no minor importance, namely the leadership of women in preventing and management of conflicts in Africa. Nevertheless, it is limited to a general view and does not analyse specific cases in each of the African countries.Item Kształtowanie się regulacji prawnej zrzeszeń sportowych. Wybrane aspekty krajowe i prawnomiędzynarodowe(Wydawnictwo Naukowe UAM, 2016) Kołaczkowski, Bartosz; Diallo, Boubacar SidiItem The Protection of the Fundamental Rights of the Child in the Light of the African Charter on the Rights and Welfare of the Child(Wydawnictwo Naukowe UAM, 2018) Diallo, Boubacar SidiThe adoption of a binding international treaty on the rights of the child is presented by practitioners and researchers as a “revolution”, marking the transition from the legal status of the child as a subject of the right, to a full actor of rights protection. For the fundamental rights of the child not to remain merely theoretical, but to become concrete and meaningful, it is important to provide them with effective judicial protection. This issue is more than ever topical, with the adoption by the United Nations General Assembly of the Optional Protocol to the Convention on the Rights of the Child establishing a procedure for the submission of communications, which entered into force on 14 April 2014. This new Optional Protocol gives children the right to appeal to the Committee on the Rights of the Child when the rights protected by the Convention and its firsttwo protocols are violated. The purpose of this brief study is to analyze the African Charter on the Rights and Welfare of the Child (African Charter), adopted in 1990, which is the firstregional legal text for children specificallyand as such unique, since no other region in the world has so far developed such a protection mechanism.Item The Right to Inclusive Education in the Light of the Convention on the Rights of Persons with Disabilities(Wydawnictwo Naukowe UAM, 2018) Diallo, Boubacar SidiThis article examines the rights of persons with disabilities in the field of inclusive education based on fundamental human rights outlined in the Convention on the Rights of Persons with Disabilities. Inclusive education is essential to achieve universal respect for the right to education, including persons with disabilities. Only inclusive education systems can offer persons with disabilities both quality education and the opportunity to improve their social situation. Inclusive education is not just about placing students with disabilities in mainstream educational institutions; it also means making them feel welcome, respected and valued. The values that underlie the concept of inclusive education reinforce the capacity of everyone to achieve their goals and to conceive of diversity as a source of enrichment. Students with disabilities need appropriate support to participate in the education system on an equal basis with other students. Ordinary educational institutions must provide students with disabilities with a learning environment that maximizes academic progress and socialization.
