Abstract

Umowa o rejestrację domeny internetowej to kontrakt zawierany pomiędzy podmiotem sprawującym funkcję rejestru określonej domeny a rejestrującym. W jego treści mieści się głównie obowiązek rejestracji i utrzymywania domeny internetowej. Rozprawa doktorska składa się z dziewięciu rozdziałów, które dzielą się na podrozdziały w różnej liczbie. Pierwszy z rozdziałów zawiera ogólny zarys problematyki domen internetowych. W rozdziale drugim znajdują się rozważania na temat charakterystyki stron umowy o rejestrację domeny internetowej. W kolejnym rozdziale podjęto próbę określenia statusu prawnego domeny internetowej jako takiej w polskim prawie cywilnym oraz wskazania jej miejsca w systemie prawa cywilnego, jako przedmiotu stosunku cywilnoprawnego. W rozdziale IV skupiono się na analizie problematyki zawarcia umowy o rejestrację domeny internetowej. Wywody ujęte w rozdziale piątym traktują o treści umowy o rejestrację domeny internetowej. Rozdział VI zawiera porównanie umowy o rejestrację domeny internetowej z wybranymi kontraktami nazwanymi. Kolejny rozdział opisuje problematykę wygaśnięcia stosunku umownego między abonentem a operatorem rejestru. W rozdziale ósmym przedstawiono zagadnienie odpowiedzialności kontraktowej stron umowy o rejestrację domeny internetowej. W ostatnim rozdziale sformułowano propozycję ustawowego uregulowania omawianej umowy.

A domain name registration agreement is a contract between an entity that performs the function of a domain name registry and a registrant under which the registry is obliged to register and maintain the domain name. This doctoral thesis consists of nine chapters divided into a varying number of subsections. The opening chapter provides a general description of domain names issues. The second chapter discusses the characteristics of the parties of a domain name registration agreement. The next chapter attempts to define the legal status of a domain name in Polish civil law and to define its place as the subject of a legal relationship under civil law. Chapter IV focuses on the analysis of issues concerning the question of entering into a domain name agreement. Chapter V thoroughly examines the obligations of the registry in relation to the registrant as well as the rights and obligations of the registrant in relation to the registry. Chapter VI provides a comparison between a domain name registration agreement and selected nominate contracts. The next chapter addresses issues regarding the termination of a legal relationship between the parties of a domain name registration agreement. Chapter VIII deals with the problem of contractual liability of the parties of domain name registration agreement. The last chapter of the thesis proposes a statutory regulation of such contract.
