Ochrona małoletniego pokrzywdzonego podczas przesłuchania – standardy krajowe i europejskie

Abstract

Celem artykułu jest zaprezentowanie proceduralnych aspektów przesłuchania małoletniego pokrzywdzonego w trybie art. 185a k.p.k. w świetle unijnych standardów minimalnych dotyczących ochrony ofiar przestępstw wynikających z dyrektyw 2011/92/UE, 2011/36/UE oraz 2012/29/UE. W opracowaniu wykazano, że prawo krajowe przewiduje środki zwiększające poziom ochrony pokrzywdzonych dzieci, jednakże niektóre ze standardów minimalnych nie zostały zapewnione. Autorka na poparcie swojego stanowiska wskazuje, że prawo krajowe nie przewiduje procedury indywidualnej oceny służącej ustaleniu szczególnych potrzeb ofiar w zakresie ochrony z uwzględnieniem ich woli. W artykule została poruszona także problematyka udziału małoletniego pokrzywdzonego w konfrontacji i okazaniu. Autorka prezentuje różne poglądy doktryny oraz stara się odpowiedzieć na pytanie, czy te szczególne formy przesłuchania powinny być objęte zakresem zastosowania art. 185a k.p.k.

The article aims to present procedural rules of questioning aggrieved minors under article 185a of the Code of Criminal Procedure within the context of the EU minimum standards on the protection of victims of crime, established in directives: 2011/92/EU, 2011/36/EU and 2012/29/EU. The paper proves that national law introduces measures enabling a higher level of protection of aggrieved children, nevertheless some of the minimum standards have not been met. The author supports this view by pointing out that national law does not provide individual assessment while taking into account particular needs of the victims regarding their protection and considering their will. This paper also draws attention to a problem of confrontation and presentation with aggrieved minors. Different views of legal reviewers are presented as well as the author tries to provide the answer to the question if these forms of examination shall fall within the scope of article 185a of the Code of Criminal Procedure.
