Sustainable lending – public law interference in the freedom of economic activity on the consumer credit market

Abstract

Ponadto digitalizacja oceny zdolności kredytowej, zautomatyzowane procesy podejmowania decyzji i wykorzystanie danych konsumentów uzyskanych w świecie cyfrowym stwarzają ryzyko dyskryminacji konsumentów w dostępie do kredytu. W pracy wykazano, że regulacje prawne obowiązujące na rynku kredytów konsumenckich powinny przyczyniać się do realizacji Celów Zrównoważonego Rozwoju określonych w Agendzie 2030, w szczególności przeciwdziałania ubóstwu (Cel 1), zapewnienia dobrobytu społecznego (Cel 3), wysokiej jakości edukacji (Cel 4), równego dostępu do produktów kredytowych (Cel 5 i 10), zrównoważonego wzrostu gospodarczego (Cel 8) oraz zrównoważonej konsumpcji (Cel 12). The main research objective of this doctoral dissertation was to determine the scope of public-law interference in the freedom of economic activity on the consumer credit market in order to implement sustainable lending. Sustainable lending refers to the concept of sustainable development defined as a principle in Article 5 of the Constitution of the Republic of Poland. Numerous documents of the United Nations indicate that the principle of sustainable development should be implemented within three pillars: economic, social, and environmental. The interrelations between economic, environmental, and social interests are clearly visible on the consumer credit market. Consumer credit is an important element of the economy (economic pillar), enabling society to satisfy its needs (social pillar), and directly affecting the level of consumption (environmental pillar). The risk of concluding a credit agreement on terms that do not correspond to the consumer’s needs and financial capabilities may - at the individual level - prevent the consumer from fulfilling the obligations arising from the credit within the time limits specified in the agreement, and - at the systemic level - may affect social welfare. Moreover, the digitalization of creditworthiness assessments, automated decision-making processes, and the use of consumer data obtained in the digital environment create the risk of discrimination in access to credit. The dissertation demonstrates that the legal regulations applicable to the consumer credit market should contribute to the achievement of the Sustainable Development Goals set out in the 2030 Agenda, in particular the eradication of poverty (Goal 1), ensuring social well-being (Goal 3), high-quality education (Goal 4), equal access to credit products (Goals 5 and 10), sustainable economic growth (Goal 8), and sustainable consumption (Goal 12).
