Polish and English contracts concerning Copyrights – a comparative legilinguistic analysis
Abstract
Niniejsza praca jest monografią z zakresu komparatystyki legilingwistycznej polsko-angielskiej w ujęciu translatologicznym. Praca szeroko omawia zagadnienia związane z polską i angielską odmianą lingua legis oraz przedstawia ogólną charakterystykę systemu prawnego Polski, Wielkiej Brytanii i Stanów Zjednoczonych, ze szczególnym uwzględnieniem zagadnienia praw autorskich. Nadrzędnym celem dysertacji jest komparatystyczny polsko-angielski opis prawnej i prawniczej rzeczywistości językowej. Oprócz tego praca ma na celu ukazanie różnic i podobieństw pomiędzy systemami prawnymi Rzeczpospolitej Polskiej, Wielkiej Brytanii oraz USA, ustalenie zbioru terminów ekwiwalentnych oraz schematów zdaniowych z zakresu przeniesienia praw autorskich. Celem pracy jest również stworzenie rzetelnego źródła referencyjnego dla tłumaczy specjalistycznych polsko-angielskich z zakresu prawa autorskiego. Obraną metodą badawczą w niniejszej pracy jest analiza literatury przedmiotu i obserwacja empiryczna oraz zestawienie tekstów porównywalnych (m.in. teksty ustaw angielskich i polskich).
The aim of this study is to provide a systematic comparative description of both grammatical and lexical features of Polish and English languages of law based upon the example of contracts concerning the transfer of copyrights. The research material consists of copyright contracts and copyright acts binding in Poland, Great Britain and the United States of America. The reason why copyright law was chosen for the purposes of comparative analysis was, first and foremost, the subject matter of intellectual property. Nowadays, the topic of intellectual property is widely discussed. Also, the convergence of the form of such texts, as well as the language specificity of contracts determined the choice. However, the subject of copyright due to progressive globalization and international character is similar in many respects in Polish and English language. The research objective is to describe English and Polish features of language of the law. Therefore that research primal purpose is to conduct a basic comparison between English and Polish language of law. Also, the terminology has been compared in order to reveal similarities and differences in the meaning of selected terms.
