Texts of contracts formulated under the Civil Code in translation
Abstract
Dysertacja dotyczy analizy polskiego i francuskiego języka prawa zobowiązań umownych, a konkretnie polskiego i francuskiego języka umów regulujących czasowe używanie rzeczy. Rozdział pierwszy zawiera przegląd istniejącego stanu badań polskiego języka prawa oraz opis kształtowania się francuskiego prawa i języka prawa. W drugim rozdziale przedstawiono z kolei stan badań przekładoznawczych w uwzględnieniem dawnych i współczesnych teorii tłumaczenia. Rozdział trzeci dotyczy charakterystyki przykładowych instytucji prawa cywilnego regulujących używanie rzeczy, gdyż zrozumienie terminologii prawnej i prawniczej przez tłumacza wiąże się z koniecznością dogłębnego zaznajomienia się z rzeczywistościami prawnymi, których ona dotyczy. W kolejnym, czwartym rozdziale pracy scharakteryzowano wybrane cechy języka umów w aspekcie translatologicznym. Opisano zarówno cechy leksykalne, gramatyczne jak i inne, które zostały zilustrowane przykładami z analizowanych umów. Następnie w ramach poszczególnych klauzul umownych omówiono problemy przekładowe, uwypuklono podobieństwa i różnice na poziomie zdań, syntagm i wyrazów.
The thesis deals with the analysis of the Polish and French language of contractual obligations, and in particular the Polish and French contracts for the temporary usage of property. The first chapter is devoted to the overview of the state of the art in the field of the Polish language of the law and the development of the French language of the law. The second chapter touches upon the state of the art in translation with the emphasis put on the development of translatology throughout the ages till modern times. The third chapter discusses the features of selected civil law institutions referring to the usage of property. The author considers it essential to understand and comprehend legal terminology to be able to translate legal texts and this, in turn, entails a deep knowledge of legal realities in which such terminology is rooted. The last, fourth chapter of the thesis is devoted to the features of the language of contracts for the purpose of translation including the following ones lexical, grammatical and others. They have been amply illustrated with examples from analysed contracts. Finally, investigating typical contractual clauses the author has elaborated on the problem of their translation and highlighted similarities and differences at the level of sentences, syntagms and words.
