Definition of project supervisor in the construction process
Abstract
Niniejsze opracowanie dotyczy pojęcia inwestora zastępczego w polskim prawodawstwie i nauce materialnego prawa administracyjnego. Celem artykułu jest znalezienie odpowiedzi na pytanie o to kim jest inwestor zastępczy w procesie budowlanym i czy taki podmiot może w nim występować. Tenże proces ma przede wszystkim charakter publicznoprawny i różni się od procesu inwestycyjno-budowlanego, w którym duże znaczenie mają również regulacje prawa prywatnego. Powyższe stwierdzenie jest nie bez znaczenia dla rozumienia pojęcia inwestora zastępczego, którego definicji nie ma w polskim prawodawstwie. W procesie budowlanym inwestor ma prawa i obowiązki przede wszystkim o charakterze publiczno-prawnym, co rodzi konkretne konsekwencje prawne. Nie sposób nie zauważyć, że pojęcie inwestora zastępczego pojawia się w aktach normatywnych i jest powszechnie używane w języku prawniczym.
The study describes the term of a project supervisor in the Polish legislation and science of administrative substantive law. The aim of this study is answer the question who is the project supervisor in the construction process and whether such entity can take a part therein. First of all, this process has a public-law character and is different from the investment-construction process, where the regulations of private law are also very important. This statement is necessary to understand the term - project supervisor, whose definition is not present in the Polish legislation. In the construction process the investor has rights and obligations of public-law character which translate into particular legal consequences. It is impossible not to notice that the term - project supervisor appears in normative acts and is commonly used in lawyers’ language.
