Ocena działań podejmowanych przez MTK wobec Prezydenta Federacji Rosyjskiej

Abstract

Dnia 17 marca 2023 roku II Izba Przygotowawcza MTK wydała nakaz aresztowania Władimira Władimirowicza Putina. Zgodnie z komunikatem Władimir Władimirowicz Putin, urodzony dnia 7 października 1952 roku, prezydent Federacji Rosyjskiej, jest rzekomo odpowiedzialny za zbrodnię wojenną polegającą na bezprawnej deportacji ludności – dzieci, oraz bezprawnym przesiedlaniu ludności – dzieci, z okupowanych obszarów Ukrainy do Federacji Rosyjskiej (zgodnie z art. 8 ust. 2 lit. a pkt VII oraz lit. b pkt VIII Statutu Rzymskiego). Jest to pierwszy nakaz wydany wobec aktualnie urzędującej głowy państwa. Niewątpliwie jest to również sprawdzian dla funkcjonowania MTK oraz ustalenia jego pozycji jako stałego sądu międzynarodowego. Artykuł ma na celu dokonanie analizy, a następnie oceny działań podejmowanych przez Międzynarodowy Trybunał Karny względem Prezydenta Federacji Rosyjskiej Władimira Putina, w kontekście konfliktu rosyjsko-ukraińskiego. Przede wszystkim zwraca również uwagę na kwestię realności podejmowanych działań.

On 17 March 2023, the Second Pre-Trial Chamber of the ICC issued an arrest warrant for Vladimir Vladimirovich Putin. According to the statement, Vladimir Vladimirovich Putin, born on October 7, 1952, the President of the Russian Federation, is allegedly responsible for a war crime involving the unlawful deportation of the population – children, and the unlawful resettlement of the population – children, from the occupied areas of Ukraine to the Russian Federation (pursuant to Art. 8 sec. 2(a)(VII) and (b)(VIII) of the Rome Statute). This is the first such warrant issued against a currently serving head of state. Undoubtedly, this is also a test for the functioning of the ICC and the establishment of its position as a permanent international court. The article aims to analyze and then evaluate the actions taken by the International Criminal Court against the President of the Russian Federation, Vladimir Putin, in the context of the Russian-Ukrainian conflict. Above all, it also draws attention to the issue of the reality of the measures taken so far.
