Doręczenia pism sądowych w postępowaniu cywilnym w obrocie krajowym

Abstract

Przedmiotem pracy jest próba analizy instytucji doręczeń pism sądowych w polskim postępowaniu cywilnym. Doręczenie pism sądowych jest czynnością procesową, pomocniczą sądu i zarazem konwencjonalną, warunkującą prawidłowy przebieg postępowania sądowego, wywierającą skutki procesowe i materialnoprawne. Instytucja doręczeń została zdeterminowana przez zasadę oficjalności doręczeń oraz zasadę bezpośredniego dokonywania doręczeń. Omawianą czynność procesową charakteryzuje ścisła formalizacja co do podmiotu, miejsca i czasu jej dokonania, co z jednej strony gwarantuje prawa procesowe strony, a z drugiej strony uniemożliwia przedłużanie postępowania na skutek nieodbierania pism sądowych przez strony postępowania. Zasadniczym celem opracowania było ukazanie ogromnego znaczenia doręczeń dla przebiegu całego postępowania cywilnego. Usystematyzowano poszczególne sposoby doręczeń, poświęcając osobny rozdział doręczeniom dokonywanym za pośrednictwem systemu teleinformatycznego. Zauważono, iż instytucja doręczeń przeszła ewolucję od osoby woźnego do elektronicznych nośników informatycznych. Doręczenie pism sądowych zgodnie z wymogami wprowadza określony porządek czynności, którego przestrzeganie powoduje stabilność postępowania cywilnego. Zwrócono uwagę na praktyczne problemy związane z doręczeniem pism, a także z wykładnią przepisów regulujących omawianą instytucję. Doręczenie jest celem pośrednim stojącym na drodze do osiągnięcia celu końcowego – prawidłowego zakończenia postępowania cywilnego.

The object of this study is to analyze the institution of the service of process in the Polish civil proceedings. The service of process is an auxiliary court procedure act, and at the same time it is a conventional act which conditions the normal course of judicial proceedings. It has procedural and substantive effects. The institution of the service of process was determined by the principle of formality of delivery and the principle of direct service of process, and it impacts some of the procedural principles. The procedural act in question is strictly formalized with regard to the subject, time and place of its performance, which on the one hand guarantees the procedural rights of the parties, and on the other hand makes it impossible to prolong the proceedings due to the failure to receive legal documents by the parties. The main aim of the study was to show the great importance of the service of process to the course of the civil proceedings. The service of judicial documents in accordance with statutory requirements and introduces a certain order of procedure, the observance of which contributes to the stability of civil procedure. The various ways of service were systematized in the study, with a separate chapter devoted to the service of process carried out via the electronic system. It was noted that the institution has evolved from the services of the bailiff to the electronic media service. Attention was drawn to the practical problems associated with the delivery of documents, as well as the interpretation of the various provisions governing the institution discussed. The service of process is an intermediate goal on the way to achieving the final objective - the proper completion of civil procedure.
