| dc.description.abstract | Celem rozprawy jest udzielenie odpowiedzi na pytanie, jaką rolę w procesie polskiej transformacji ustrojowej odegrał Trybunał Konstytucyjny. Zawarta w pracy analiza pozwala ustalić, czy działalność orzecznicza Trybunału Konstytucyjnego stanowiła rodzaj (model) procesu legitymizacji systemu prawa, a więc procesu wykazywania, że nowy system prawa jest prawowity (legitymowany, słuszny). W ramach realizacji wymienionego wyżej celu w pracy przedstawione zostały dotychczasowe ustalenia teoretyczne w zakresie wskazanej problematyki oraz wyniki badań empirycznych na reprezentatywnych orzeczeniach Trybunału Konstytucyjnego, wydanych w latach 1989-1997. W wyniku przeprowadzonych badań wyodrębnione zostały takie orzeczenia Trybunału Konstytucyjnego wydane w okresie transformacji ustrojowej, które zawierają argumentację legitymizującą nowo tworzony system prawa. Innym celem pracy jest wykazanie, że wraz z legitymizacją nowego systemu prawa, Trybunał dokonywał delegitymizacji norm obowiązujących w systemie poprzednim. Analizie poddano przebieg transformacji ustrojowej z perspektywy aktywności sądu konstytucyjnego, który uzupełniał lub korygował działalność ustawodawcy. Wyniki przeprowadzonych badań empirycznych wskazują na kolejny, nie analizowany dotąd, aspekt polskich przeobrażeń ustrojowych, tj. na prowadzenie przez Trybunał Konstytucyjny procesu legitymizacji nowego systemu prawa. | pl |
| dc.description.abstract | The purpose of the doctoral thesis is to answer the question about the role that the Constitutional Tribunal played during the transformation period in Poland. The analysis included in the dissertation allows to determine whether the judicial activity of the Constitutional Trubinal was the type (model) of the legitimization of the legal system, i.e. the process of demonstrating that the new legal system is rightful (legitimate, lawful). Within the framework of this purpose, the dissertation consist of the presentation of the previous theoretical arrangements in respect of the indicated issues and the results of empirical studies on representative judicial decisions of the Constitutional Tribunal issued in 1989-1997. The conducted studies enable to distinguish judicial decisions of the Constitutional Tribunal issued during the transformation, which contain argumentation legitimizing the new legal system. Another aim of the dissertation is to demonstrate that along with the legitimization of the new legal system, the Tribunal also conducted the delegitimization of the norms binding in the previous system. The analysis of the transformation period was carried out from the perspective of the Constitutional Tribunal activity, which was supplementing or correcting the legislature activity. The results of the empirical studies indicate the next, not analyzed so far, aspect of Polish transformation, i.e. legitimization of the new legal system conducted by the Constitutional Tribunal. | pl |
