| dc.description.abstract | The subject of the paper is to present regulations and practice concerning the application of food and health claims in the United States. The evolution of the adopted solution was shown and types of specific categories of claims are presented, together with the requirements and procedures of authorising the sale of these products.In view of the analysis of these regulations, systemic differences were considered in terms of the approach to the regulation of nutritional and health claims in the USA and in the European Union. The main difference arising from the comparison pertained to boundaries between consumer protection and support for the innovative development of activity on the part of food producers. The American system proved to be more producers-oriented, while the European system is more focused on the protection of consumers (consumers-oriented), which in many areas justifies limitations in the activity of entrepreneurs, being more far-reaching than in the USA. | pl_PL |
| dc.description.abstract | L’oggetto dell’articolo è di presentare le regolazioni e la pratica concernenti l’impiego delle indicazioni nutrizionali e sulla salute negli Stati Uniti d’America. È stata illustrata l’evoluzione di soluzioni accettate in questo ambito, sono stati presentati diversi tipi di categorie distinte di dichiarazioni nonché le esigenze e le procedure per l’ammissione alla circolazione. Sullo sfondo dell’analisi di queste regolazioni sono state effettuate considerazioni sulle differenze sistemiche nell’approccio riguardo alla regolazione delle indicazioni nutrizionali e sulla salute negli Stati Uniti e nell’Unione europea. La differenza principale che emerge dal confronto interessa i confini tra la tutela dei consumatori e la promozione dello sviluppo innovativo dell’attività dei produttori alimentari. Il sistema americano ha dimostrato di essere più favorevole ai produttori (producers oriented), mentre il sistema europeo è più focalizzato sulla tutela dei consumatori (consumers oriented), la quale in molte aree legittima le restrizioni che vanno oltre quelle degli Stati Uniti sulle attività degli imprenditori. | pl_PL |
