Comparing French and Polish inheritance law terminology
Abstract
Niniejszą rozprawę autorka rozpoczęła od prezentacji stanowiska polskiej i francuskiej nauki – legilingwistyki (linguistique juridique), co do tego czym jest język prawa i jakie są jego formy. Następnie określiła przedmiot badań, którym jest terminologia prawa spadkowego. Przedstawiła badania dotyczące teorii przekładu, których rozwój pozostaje w ścisłym związku z kształtowaniem się teoretycznych podstaw tłumaczenia prawniczego. Omówiła zalecaną przez teoretyków przekładu prawniczego koncepcję ekwiwalencji dynamicznej(funkcjonalnej) oraz inne, podnoszone przez badaczy, aspekty przekładu. Wskazała ograniczenia, które należy brać pod uwagę w procesie tłumaczenia terminów prawnych oraz strategie tłumaczenia prawniczego, stosowane w zależności od typu odbiorcy i rodzaju tłumaczonego tekstu. Praca zawiera definicję prawa spadkowego oraz zwięzły opis ewolucji jego podstawowych instytucji na kontynencie europejskim. Wpływ Kodeksu Napoleona na terminologię polskiego prawa spadkowego został zilustrowany przykładami terminów zapożyczonych z języka francuskiego. Autorka porównała francuską i polską terminologię prawa spadkowego. Zbadała znaczenie terminów podstawowych: „spadkodawcy”, „spadkobiercy”, „spadku” i „dziedziczenia” oraz ich relacje semantyczne z innymi terminami, prawnymi i prawniczymi, w ramach ich rodzimego systemu prawnego oraz w stosunku do terminów obcojęzycznych. W dalszej części pracy zawarła analizę terminów występujących w przepisach kodeksu cywilnego, odpisie aktu zgonu, dokumencie poświadczającym dziedziczenie oraz w testamentach: holograficznym i notarialnym. Teksty francuskie autorka porównała z paralelnymi tekstami polskimi. Omówiła najczęstsze błędy w tłumaczeniu terminologii prawa spadkowego, z którymi zetknęła się podczas swojej pracy dydaktycznej. Na końcu rozprawy znajduje się alfabetyczny spis wszystkich terminów wraz z polskimi ekwiwalentami.
This work begins with a presentation of notions of language of the law and jurist language and their forms as understood by theoreticians of the Polish legal linguistics and French linguistique juridique. The author next defines the subject of the research– inheritance law terminology. She presents the research into translation theory, the development of which remains strictly tied to the ongoing formation of the theoretical bases of legal translation. She also introduces the concept of dynamic (functional) equivalence, along with other aspects of translation raised by researchers. Further, the author has indicated the limitations that must be borne in mind during the process of translating legal terms, as well as when pursuing strategies for legal translation applied in regard to the type of recipient and type of translated text. The author also includes the definition of inheritance law and a succinct description of the evolution of its basic institutions in continental Europe. She illustrates the impact of the Napoleonic Code on the Polish terminology of inheritance law with examples of terms borrowed from French. Subsequently she compares the French and Polish terminology of inheritance law. She has researched the meaning of the basic terms: ‘testate/intestate deceased’ (défunt), ‘heir’ (successeur), ’inheritance’ (succession), and ‘succession’ (dévolution successorale), along with their semantic relations with other legal terms in the scope of the Polish legal system and in regard to foreign-language terms. In the next part of the thesis the author analyzes the terms appearing in texts pertaining to inheritance law, thus: provisions of the civil code, a death certificate, a certificate of inheritance and testaments, both holographic and notarial one. She compares the French texts to parallel texts in Polish. The author describes the mistakes in translating the terminology of inheritance law which she most often encounters in her teaching work. An alphabetical listing of all terms, together with their Polish equivalents, is found at the back of this dissertation.
