CITIZENS’ ASSEMBLIES IN SWITZERLAND
Abstract
Artykuł dotyczy jednej z najstarszych form demokracji bezpośredniej – odbywanych pod gołym niebem kantonalnych zgromadzeń ludowych w Szwajcarii o nazwie Landsgemeinde. Autor omawia źródła tej oryginalnej instytucji. Jej początki datuje się na okres średniowiecza. Pierwsze Landsgemeinden pojawiły się w XIII w. Były znane w ośmiu kantonach i półkantonach, jednak w sześciu z nich instytucja ta została zniesiona. Obecnie zgromadzenia te występują w kantonach Glarus i Appenzell-Innerhoden. Szczególną uwagę zwrócono na organizację i kompetencje zgromadzeń ludowych. Należy do nich wybór kantonalnej egzekutywy, dokonywanie zmian w konstytucji kantonalnej oraz uchwalanie ustaw, jak również decydowanie o wydatkach kantonu. Kolejna część została poświęcona praktycznym aspektom funkcjonowania Landsgemeinde. Zgromadzenia ludowe odbywają się raz w roku i mają uroczystą formę. Zebranie ogółu uprawnionych trwa zwykle kilka godzin. W uwagach końcowych autor wskazuje na znaczenie Landsgemeinde jako jednej z najbardziej zakorzenionych form politycznej partycypacji na szczeblu kantonalnym.
*The paper concerns one of the oldest forms of direct democracy – the open-air citizens’ assemblies in Switzerland called Landsgemeinde. The author discusses the sources of this unique institution. Its history dates back to the Middle Ages. The first Landsgemeinden took place in the 13th century. Originally, they were organised in eight cantons and half-cantons, but later this institution was abolished in six, to remain only in the cantons of Glarus and Appenzell-Innerrhoden. Special attention has been drawn to the organisation and the powers of the assemblies. They are responsible for choosing the cantonal executive, the passing of the constitutional and legislative laws and deciding about cantonal expenses. Some practical aspects of the Landsgemeinden have also been analysed. The assemblies are held once a year and are a solemn ceremony. The gatherings usually last several hours. Concluding the paper, the author points out to the significance of the Landsgemeinde as one of the most deeply-rooted forms of political participation on the cantonal level.
