Public law regulation of gambling activities and legal guarantees of freedom of economic activity
Abstract
W niniejszej dysertacji dokonano opisu oraz szczegółowej charakterystyki celów i dobranych środków publicznoprawnej reglamentacji, mających zastosowanie wobec urządzania gier hazardowych. Obowiązujący system reglamentacji zestawiono również z wybranymi orzeczeniami Trybunału Sprawiedliwości Unii Europejskiej oraz Trybunału Konstytucyjnego, dotyczącymi urządzania gier hazardowych. Istota rozważań podjętych w rozprawie polega na wyszczególnieniu i charakterystyce elementów składających się nie tylko na reglamentację (przyjętych środków i celów) działalności gospodarczej w zakresie urządzania gier hazardowych, ale również na pozostałe (równie istotne) elementy wpływu państwa na aspekty ściśle powiązane z urządzaniem gier hazardowych. W myśl tak sformułowanej problematyki badawczej ustalono trzy główne cele badawcze. Pierwszy z nich dotyczył ustalenia instrumentarium reglamentacji oraz identyfikacji celów reglamentacyjnych. Kolejnym cel badawczy polegał na ocenie systemowej polityki hazardowej władz publicznych. Ostatni cel badawczy pracy stanowił ocenę wpływu orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej i Trybunału Konstytucyjnego na warunki prowadzenia działalności gospodarczej opierającej się o urządzanie gier hazardowych.
This dissertation provides a description and detailed characterisation of the objectives and selected public law rationing measures applicable to the organisation of gambling. The applicable system of rationing has also been juxtaposed with selected rulings with selected judgments of the Court of Justice of the European Union and the Constitutional Court concerning the organisation of gambling. The essence of the considerations undertaken in the dissertation consists in the specification and characterisation of the elements comprising not only the rationing (of the adopted measures and objectives) of economic activity in the field of gambling establishment, but also the other (equally important) elements of the state influence on the aspects strictly connected with gambling establishment. In line with the research problem formulated in this way, three research objectives were established. The first was to establish the regulation of rationing and to identify rationing objectives. The next research objective was to assess the systemic state gambling policy. The last research objective of the study was to assess the impact of the jurisprudence of the Court of Justice of the European Union and the Constitutional Court on the conditions of conducting economic activity based on the organisation of gambling.
