Pozyskiwanie biomasy z gruntów rolnych a bezpieczeństwo żywnościowe – wybrane aspekty prawne

The allegedly positive effects of using biomass for energy are being frequently challenged today. Reservations arise particularly in light of the resulting land use change, which is a potential threat to the supply of food, has a negative impact on the balance of nature and biological diversity, and may jeopardise the climate protection programme. The paper is an attempt to determine the extent to which the European Union law accounts for food security requirements in the context of an increased demand for biomass, and how these issues have been regulated in some EU member states. It concludes with a recommendation that strong support should be given to initiatives aimed at imposing legal limitations with regard to the qualitative share of biomass from edible foods and fodder, and that the ways in which land and agricultural crops are used should be monitored. The initiatives advocating utilisation of all waste, residue and byproducts in the process of biomass production are also encouraged.
