    Wspólna Polityka Rolna – doświadczenia i przyszłość

    The negotiations on the shape of the Common Agricultural Policy (CAP) for the period after 2013 have entered into a decisive phase. The Danish presidency in the EU, which ended in June 2012, summed up the outcome of the up till then consultations, the effect of which is contained in a report on the CAP in the new programming period. The report refers to the changes proposed by the European Commission and presents the convergence as well as divergence zones among EU member states in respect of the proposed individual solutions. The aim of the paper was to assess the proposals presented in the draft amendment paper in the context of the Polish agricultural sector’s interests in three areas that the authors view as most important: direct payments, market investments and rural areas development policy. In the authors’ opinion this is a very complex and, in many aspects, disputable issue. Concessions to be made by every member state seem indispensable. A detailed analysis of the report and the document prepared by the EC show that although there are many beneficial provisions for Polish agriculture, there are also ones that may have a negative impact on the development of that sector.

    Odpowiedzialność administracyjna sprzedawcy detalicznego za wprowadzenie do obrotu artykułu rolno-spożywczego zafałszowanego

    The focus of the paper is the liability of a retailer before administrative courts for marketing fake or counterfeit agricultural products, and resolution of the doubts regarding the statutory regulation of the issue. The monetary penalty for the above act constitutes an important means of agricultural product market supervision and is one of the major stra-tegic elements of that market. The statutory regulation of that matter is not free from de-fects, thus entailing certain doubts as to the construction of the applicable legislation. The author finishes the paper with a conclusion that complete elimination of the procedure in which fake or counterfeit products are introduced for trading in the market is not possible due to the gains it generates to those who do so. Only monetary penalties in amounts that would ‘eat out’ the gains might be an efficient remedy. Although theoretically possible, this solution fails to work in practice.

    Ochrona kwalifikowanych nazw geograficznych. Propozycje interpretacyjne prezentowane w Hiszpanii i Unii Europejskiej

    Since 1990s protection of the qualified geographical designations has been harmonised with the protection system at the EU level. Its main characteristic is the granting of an exclusive right which, generally speaking, acts parallel to the right arising from registration of a trademark. In this context, the concept of ‘reference’ that appears as an autonomous conduct prohibited by law is analysed. The deliberation presented in the paper also concerns the protection of designation of origin and the EU provision aiming to define ius excludendi alios the collective character of those rights within the scope of industrial law. Concluding, the author makes an attempt to establish which construction (interpretation of the existing laws), the Spanish one or that of the European Union law, is more advantageous from the point of view of the protection of Protected Designation of Origin.

    Z prawnej problematyki zakładania i prowadzenia działalności przez spółdzielcze grupy producentów rolnych

    The aim of the paper was to identify the legal aspects of establishing and carrying out economic activity by cooperative groups of agricultural producers. Although there have been attempts to simplify the process of establishing and running agricultural business (amendments to the existing law on groups of agricultural producers and the provisions of cooperative law), there are still a number of provisions that raise doubts as to their interpretation. To help maintain durable structures, it would certainly be recommendable to oblige groups to carry out economic activity for at least 10 years as well as to prolong the required minimum period of belonging to an agricultural producers group. The possibility of passing a resolution allowing to liquidate a group of agricultural producers after the EU funds have been utilised does not encourage creation and maintenance of strong, competitive groups. Further development of agricultural producers groups in Poland requires continued financial support from the European Union going also after 2013. The EU funds should go to new groups of producers as well as those already operating in the market, and the scale of assistance should depend not only on the income of the agricultural producers group, but also the number of their members.

    The market position of participants of a food supply chain is very diversified and the imbalance that exists among the participants may result in the strong ones taking advantage of the dominant position and then indulging in dubious trading practices. The analysis of the regulations of the trading practices that govern the relationships in the food supply chain in Poland and Italy allows to formulate an opinion that the Italian regulation is more protective towards the weaker market participants. However, only future practice will show whether the more protective provisions of the Italian antimonopoly law will effectively improve the situation of food suppliers.

    Wymogi bezpieczeństwa i higieny żywności w sprzedaży bezpośredniej produktów rolnych w prawie Unii Europejskiej

    The aim of the paper is to establish the scope of the EU food hygiene and safety regulations that bind agricultural producers and the extent to which an individual member state may derogate from them. The European Union law does not provide for any hygiene requirements with regard to direct agricultural products supplies (primary production), leaving relevant food safety and no-risk for public health legislation in the hands of member states. Primary production is subject to general and less rigorous requirements set out in regulation 852/2004, whereas to secondary production the more detailed and more restrictive provisions of appendix II of regulation 852/2004 and the provisions of regulation 853/2004 concerning animal products apply. In the case of the latter, the HACCP system must be also in place.

    Geneza i ewolucja scalania gruntów rolnych w prawie niemieckim

    In the author’s opinion, the development of German consolidation law was determined by local relationships that existed in different parts of Germany, and, in particular, by the ownership relationships and existence of a number of independent German states. In consequence of the diversified ownership relationships, the consolidation law in northern Germany was different from that in north-eastern Germany, and yet different than in southern Germany. Moreover, the evolution of German consolidation law was characteristic of one process that was common to all German lands. It was a departure from the prioritising of individual interests for the sake of realising general, social objectives. From today’s perspective, we may say that basing consolidation law on the principle of general social interest as superior to individual interest was a vital step that allowed substantial acceleration of the consolidation process, making it at the same time an efficient tool for improving the conditions of working in agriculture.

    Materiały i wyroby przeznaczone do kontaktu z żywnością – wybrane aspekty prawne

    Apart from food as such, food law also pertains to materials and articles that come in contact with food. It governs all types of material, including packaging, containers, glass or plastic bottles as well as printing ink used for labelling of foodstuffs, even if it may only potentially come in contact with food. Thus it is important to know how manufacturers of materials and articles intended for contact with food protect food from dangerous sub-stances that may permeate into it accidentally, or through an intentional release of such substances into food. The authoress concludes that although materials and articles that come in contact with food belong to industrial goods, food law regulations must be ac-counted for and manufacturers. Likewise, the latter are also liable for complying with the requirements of food law that aims to protect consumers ‘from the field to the table.’

    Ubezpieczenie zdrowotne rolników

    The paper aims to determine whether the protective character of the existing system of farmers’ health insurance in Poland should be preserved, and if, to what extent. It is shown that the condition of Polish agriculture today does not justify the maintenance of a fully protective system of health insurance, and that there is a need to create a system based on a new financing model, which would involve a higher degree of contributions on the part of the insured farmers. At the same time, however, it seems obvious that adequate health protection of the insured will not be guarantied without financial assistance from the state budget. Taking into account social justice, social self-assistance and the ideas of inter-group solidarity, state support should be directed predominantly to farmers of lesser means.

    Z problematyki ubezpieczeń upraw rolnych i zwierząt gospodarskich

    The paper deals with agricultural crops and farm animals insurance as one of the main elements of agricultural production risk management. It aims to establish whether the existing statutory regulation contributes to the stabilisation of agricultural income, and whether the draft amendment to it will provide agricultural producers with a wider access to system of agricultural crop insurance. The proposed amendments are intended to promote crop insurance among farmers by, inter alia, obliging insurance companies to offer insurance packages to farmers, and determining new, and the same for all, principles fixing maximum subsidised contributions. The amendment should increase the competitiveness of agriculture by reducing the risk of lost earnings from agricultural production due to adverse weather conditions
