Powyższe zagadnienie jest niezwykle istotne dla podmiotu administrowanego, gdyż wydanie przez organ administracji publicznej aktu w przedmiocie wszczęcia postępowania administracyjnego otwiera podmiotowi administrowanemu możliwość poddania tego aktu weryfikacji poprzez uruchomienie środków prawnych. Autorzy oparli swoje rozważania na treści niedawno dodanego do Kodeksu postępowania administracyjnego art. 61a, nakazującego wydać postanowienie o odmowie wszczęcia postępowania w dwóch sytuacjach: 1) gdy żądnie zostało wniesione przez osobę nie posiadającą legitymacji procesowej strony w postępowaniu oraz 2) gdy postępowanie z innych uzasadnionych przyczyn nie może być wszczęte.Item Podmiotowość prawna gminy(Wydział Prawa i Administracji UAM, 1993) Szewczyk, MarekThe author analyses the problem of legal personality of a commune (gmina) on the grounds of some basic theoretical conceptions concerning the nature of territorial government as well as in the context of new regulations adopted in the Republic of Poland.Item Pozycja prawna delegatur Najwyższej Izby Kontroli(Wydział Prawa i Administracji UAM, 1981) Szewczyk, MarekL'auteur touche le problème de structures d'organisation de la Chambre Suprême de Contrôle (NIK). Il s'intéresse surtout â la situation juridique des délégations de la Chambre Suprême de Contrôle. L'accent y est mis sur le caractère original de la structure polonaise de l'appareil de contrôle d'Etat. De nombreuses particularités qui le distinguent de la structure adoptée dans les pays de la démocratie parlementaire et dans les pays socialistes y sont énumérées. La situation juridique des délégations de la Chambre résulte de leurs rapports avec le bureau central de NIK. Pour présenter ce rapport l'auteur de l'article essaye de répondre à la question suivante: la délégation de NIK, est-elle un organe d'Etat du point de vue juridique? La réponse positive implique les conséquences concrètes concernant la coexistence de délégation et d'autres organes d'Etat sur le même territoire. Les devoirs et les moyens juridiques dont disposent les délégations en les remplissant caractérisent aussi leur situation juridique. La Chambre Suprême de Contrôle remplit le rôle du centre qui unit les essais de tous les organes de contrôle professionnel ce qui renforce également la situation juridique des delegations. Selon l'ancienne régulation juridique cette activité portait le nom de coordination. La notion de coopération employée par le législateur à l'heure actuelle suggère les liaisons plus faibles entre les organes. Parmi les facteurs qui décident de la situation juridique dès délégations de NIK sont énumerés deux rapports avec les organes représentatifs. L'auteur de l'article propose ici la subordination qui existe au niveau central; la Chambre Suprême de Contrôle est subordonnée à la Diète. Toutes les considérations amènent à la conclusion générale. Les solutions peuvent avoir l'appréciation positive si elles facilitent aux délégations de remplir le rôle de l'organe subordonné aux organes représentatifs.Item Prawo miejscowe a przepisy gminne(Wydział Prawa i Administracji UAM, 1992) Szewczyk, Marek; Ziemski, KrystianThe authors attempt to answer the question whether the distinction present in the legislative acts, namely the distinction between „local law" and „communal law" is rational and whether it is the product of the legal doctrine or its origin is merely accidental. The authors conclude that the said distinction corresponds with jurisdictional delimitation, although the ultimate delimitation of the scope of local law and communal law may sometimes be faced with difficulties, for some communal legislation might be qualified as local law enacted by communal organs.Item Współdziałanie rad narodowych z zawodowymi organami kontroli zewnętrznej(Wydział Prawa i Administracji UAM, 1986) Szewczyk, MarekThe subject of the elaboration is the cooperation which is expected between people's councils and professionally acting subjects of control situated outside of the councils system. The said subjects are to develop the cooperation by the rule of The People's Councils and Territorial Self-government Act of 1983. The author of the article presents the issue from the people's councils viewpoint and first and foremost from the viewpoint of the act. In the first part of the article the range of subjects obliged to eoperate with people's councils in the domain of control is stated,. The subjects lare divided by the author into two groups. One of them is professional subjects of external control, situated in the administrative branch. The so called branch inspections play the essential part among the subjects of that group. The second group is subjects of professional control situated outside of the administration. Locai organizational units of the Supreme Chamber of Control are the main element of that group. Further parts of the article are devoted to discussing forms in which people's councils are to cooperate with the previously indicated institutions excercising control in the professional manner. The author distinguishes basically two groups of forms: session forms, realized by the councils at their sessions and extra-session forms. The latter are realized by the councils throught their organs. The main part is to be played lin this respect by the councils'" presidia, being the organizers of their work. In the conclusion the author indicates at virtues and shortcomings of the present regulation. In his opinion, one must positively grade ranking the peoples councils duty to cooperate with the subjects excercising control upon administration as the statutory duty, both of the peoples councils and of the said subejcts of control. The shortcomings of the present regulation are in the author's opinion (related mostly to not precise wording of the legali (regulation, particularly as regards these provisions which define the forms of peoples councils cooperation with the professional subjects of external control.
