Item ETYKA LOBBYSTY-POLITYKA W UJĘCIU PORÓWNAWCZYM(Wydział Prawa i Administracji UAM, 2008) Tokarczyk, RomanFirst glimpse at the lobbyist ethic shows that it is rooted in, inter alia, skepticism that accompanies the legal regulations of lobbying. The regulations that are binding in the US, despite their rather long tradition, have not succeeded to prevent scandals which every now and occur there. As a result, the public debate in the US as well as many other states concerns the need for a facility that would allow a clear and open process of decision making in democratic systems. Ethic dilemmas arise when the actions o f those who influence politicians challenge such fundamental democratic values as honesty and integrity, openness and the common good. The most unethical and illegal lobbying practice that impairs integrity is buying decisions of politicians that satisfy the lobbyist’s client. A possible manner in which honesty might be enforced would be to register and keep open contacts between lobbyists and politicians and report on them periodically. In the context o f the common good, the actions carried out by lobbyists resemble those of barristers. The latter, however, stand before and impartial judge, while the actions of lobbyists representing interests of influential groups are not monitored by those representing social interests.Item JEDNOSTRONNOŚĆ EKONOMICZNEJ ANALIZY PRAWA(Wydział Prawa i Administracji UAM, 2007) Tokarczyk, RomanItem Konserwatywne treści amerykańskiego populizmu(Wydział Prawa i Administracji UAM, 1980) Tokarczyk, RomanLes idées du populisme américain, qu'on classe parmi les courants radicaux de la pensée politique américaine, sont issues au fond du libéralisme américain. Elles renouent avec les mots d'ordre de défense de propriété privée, les idées libérales de l'individualisme, le consumérisme et l'égalitarisme conçu en termes de chances égales. Elles tâchent de prouver que, même au sein d'un capitalisme rapace, la conquête de la propriété privée peut être fondée sur le principe de chances égales. D'ordinaire le populisme se fait largement approuver en périodes de dépressions économiques et de crises sociales. Lorsque les conditions économiques et sociales s'améliorent, il perd ses partisans aussi vite qu'il les a gagnés; alors il fait l'éloge, sans réserve majeure, des principes fondamentaux du système social américain. La même base idéologique est à l'origine des deux courants principaux du populisme américain — celui de gauche et celui de droite. Aux confins du populisme de droite apparaissent de faibles idées fascistes. Le populisme est utilisé pour isoler la société américaine des influences de la pensée socialiste et orienter le mouvement ouvrier vers la collaboration avec le système capitaliste.Item Normatywne ujęcia antyprokreacji(Wydawnictwo Naukowe UAM, 2000) Tokarczyk, RomanFrom the dawn of history, different ways of preventing human birth have belonged tomajor normative problems. From the normative viewpoint, this prevention is usually called birth control that embraces all the relevant biological, medical, chemical and other methods. From the medical standpoint, birth control is based mainly on three methods: contraception, contra-gestation and abortion. Already primitive peoples practiced their own methods of preventing pregnancy: avoidance of intercourse at certain periods and various means of prevention: magic, medical, chemical, mechanical and surgical. One of the most controversial problems of anti-procreation is abortion. The practice of abortion is presumaably as old as human history. Three solutions compete in the normative regulations an abortion: ban, admissibility under strictly defined circumstances, and full admissibility. In legal regulations concerning abortion three models can be distinguished: either giving preference to the protecition of the pregnant woman’s interests, or the interests of the foetus, or seeking compromise between those two adverse interests. The Polish law leans towards the third model. Sterilization occupies a separate position in the vast issues of anti-procreation. The moral evalution of and regulations concerning sterilization vary depending on its voluntary or compulsory character, applied to men or women. Teresa L u b i ń s k a), s. 245-246Item ZARYS REGULACJI TRANSPLANTACJI ORGANÓW LUDZKICH(Wydział Prawa i Administracji UAM, 2000) Tokarczyk, RomanThe Author has begun his article with an enumeration of particular kinds of transplantations and an explanation of some basic notions in relation with the domain - for to give next a short description of the history of this medicine branch and of perspectives for its further development. Next some fundamental principles of transplanatory practice are presented, and namely - principle of lawfulness, objectivism, collecting of transplants from deceased persons rather, majority of givers, ban on commercialising a human body, equality of access and, finally, ban on making profits out of transplanting. The Author analyses reservations and fears involved with transplantation of organs collected from living bodies and from the dead. The Author also presents national legal regulations related to these questions and ends his article with his opinions on ethic norms in transplantology.
