Realizacja zasady lojalności procesowej wobec pokrzywdzonego w polskim procesie karnym

Abstract

Tezą pracy jest ustalenie, że na tle polskiego prawa karnego procesowego obowiązuje zasada lojalności procesowej. Tytułowa zasada prawa definiowana jest jako dyrektywa nakazująca wszystkim organom procesowym we wszystkich stadiach postępowania karnego ochraniać interesy procesowe innych uczestników tego postępowania. Zasada lojalności procesowej spełnia zatem funkcję gwarancyjną dla uczestników postępowania karnego. Wyróżniona zasada procesowa ma charakter dwupłaszczyznowy. Może ona przybierać kształt dyrektywy postępowania oraz dyrektywy interpretacyjnej. Pierwsze ujęcie polega na tym, że organy procesowe powinny respektować prawnie chronione interesy innych uczestników postępowania karnego. Pośrednio adresatem tej zasady procesowej jest także ustawodawca, który powinien tak kształtować przepisy k.p.k., aby miały one charakter gwarancyjny. Z kolei zasada lojalności procesowej jako dyrektywa interpretacyjna realizuje się na etapie stosowania prawa przez organy procesowe oraz polega na gwarancyjnej dla uczestników tego postępowania interpretacji przepisów k.p.k. Potwierdzeniem obowiązywania zasady lojalności procesowej w polskim procesie karnym są także jej ograniczenia. Należy zauważyć, iż odniesione do pokrzywdzonego przejawy oraz ograniczenia zasady lojalności procesowej pozwalają na wysunięcie ogólnego wniosku, iż jego sytuacja procesowa została należycie zabezpieczona, choć można dostrzec konieczność wprowadzenia bądź zmian określonych regulacji prawnych, które albo nie zabezpieczają, albo nienależycie zabezpieczają prawnie chronione interesy pokrzywdzonego.

The thesis work is to establish that in Polish criminal law the principle of loyalty process . The title rule of law is defined as a directive ordering all bodies process at all stages of criminal proceedings to protect the interests of other participants in the process proceedings. The principle of loyalty process performs the function of a guarantee for participants in criminal proceedings. The principle of loyalty has two aspects. It may take the form of a directive of conduct and interpretation. The first approach consists in the fact that the authorities should respect the process of legally protected interests of other participants in the criminal proceedings. Indirectly addressed to the rules of the process is also a legislator, which should shape the provisions of Code of Criminal Procedure so that they have the nature of a guarantee . In turn the principle of loyalty as a directive interpretive process is carried out at the stage of application of the law by the process, and relies on the guarantee for participants in the interpretation of provisions of the Criminal Procedure Code. The confirmation of the principle of loyalty process in the Polish criminal process are also its limitations. Concerning the victim manifestations and limits of the principle of loyalty allow the process to formulate a general conclusion that the situation of the process has been duly protected, although you can see the need to introduce or change certain regulations that are either not secure or inadequately protect the interests of the victim.
