Constitutional model of the healthcare system in Poland

Abstract

Zasadniczy cel pracy stanowi wskazanie „ram prawnych” wynikających z Konstytucji, w których ustawodawca zwykły dysponuje swobodą kształtowania systemu opieki zdrowotnej w Polsce. Nie jest możliwe wskazanie jednego „postulowanego” systemu opieki zdrowotnej, jako „jednie słusznego”, który w sposób najpełniejszy realizowałby wymogi konstytucyjne. Sfera swobody ustawodawcy zwykłego we wskazanych ramach okazuje się bowiem być stosunkowo rozległa. Jednakże w pełni realne jest wyznaczenie granic tej swobody, a więc wskazanie rozwiązań, po które prawodawca nie może sięgnąć, jeżeli nie chce narazić się na słuszny zarzut działania niezgodnego z Konstytucją. Możliwe jest również wskazanie rozwiązań, które w świetle wiedzy empirycznej wydają się lepiej lub gorzej służyć realizacji celów, jakie ustawodawca zwykły ma konstytucyjny obowiązek osiągnąć. W ramach pracy poczyniono ustalenia, na ile poszczególne cechy, które powinny w świetle Konstytucji charakteryzować opiekę zdrowotną w Polsce, są możliwe do osiągnięcia przy zastosowaniu rozwiązań zaczerpniętych z różnych „modeli” systemów opieki zdrowotnej. Rdzeń pracy stanowi wynikające z art. 68 Konstytucji prawo do korzystania z odpowiednio ukształtowanej opieki zdrowotnej. Prawo to zaliczane jest do praw człowieka i uznawane za tzw. prawo podmiotowe. Praca szczegółowo omawia cztery aspekty opieki zdrowotnej: finansowanie, zarządzanie środkami publicznymi, organizację udzielania świadczeń i odpowiedzialność prawną władz publicznych.
The fundamental aim of the thesis is an indication of "legal framework" under of the Constitution, in which the legislature has freedom to shape the healthcare system in Poland. It should be noted that it is not possible to identify a single " postulated " healthcare system as "the only right", which would realize constitutional requirements in a fullest possible way. The sphere of freedom of the ordinary legislator indicated within turns out to be relatively extensive. However, fully real is the delimitation of this freedom, and thus the indication of solutions absolutely unacceptable, which the legislature cannot apply, not to expose itself to the legitimate charge of acting incompatibly with the Constitution. It is also possible to indicate the solutions which in the light of empirical knowledge seem to serve more or less realizing the objectives that the legislature has a constitutional duty to achieve. As part of the thesis it has been made to determine how the various features that should characterize the healthcare in Poland the light of the Constitution are achievable using solutions from various " models " of healthcare systems. The core of the thesis is the right to enjoy a due shaped healthcare, which is part of a broader right to health, resulting from art. 68 of the Constitution. These rights are classified as human rights and also as recognized as so called subjective rights. The work discusses in detail four aspects of healthcare: funding, management of public funds, organization of providing health services and legal responsibility of public authorities.
