The specificity of the rehabilitation proceedings of repressed persons in the light of the files of the District Court in Poznan and the Military District Court in Poznan
Abstract
Tematem pracy doktorskiej jest postępowanie w sprawach o uznanie za nieważne orzeczeń wydanych wobec osób represjonowanych oraz postępowanie o odszkodowanie i zadośćuczynienie dla osób niesłusznie represjonowanych w oparciu o ustawę z dnia 23 lutego 1991 r. o uznaniu za nieważne orzeczeń wydanych wobec osób represjonowanych za działalność na rzecz niepodległego bytu Państwa Polskiego. Celem pracy doktorskiej jest ukazanie specyfiki postępowania w przedmiocie uznania orzeczenia za nieważne oraz postępowania o odszkodowania za wyrządzone szkody i zadośćuczynienia za doznane krzywdy. Kolejne rozdziały pracy doktorskiej przedstawiają proces powstania ustawy rehabilitacyjnej oraz instytucję rehabilitacji. Następnie omówiono postępowanie w przedmiocie stwierdzenia nieważności orzeczenia represjonującego, status procesowy osoby represjonowanej, przedmiot kontroli oraz przebieg postępowania, koncepcje postępowania w sprawach o odszkodowania w zależności od okresu i obszaru terytorialnego wyznaczonego przez ustawę, a także zostaną poddano analizie roszczenia odszkodowawcze za szkodę spowodowaną represjami. Następnie zostały przedstawione wyniki przeprowadzonych badań aktowych, których zakres terytorialny został zawężony do obszaru właściwości Sądu Okręgowego w Poznaniu oraz Wojskowego Sądu Okręgowego w Poznaniu (również w Archiwum Wojskowego Sądu Garnizonowego we Wrocławiu, Instytucie Pamięci Narodowej w Bydgoszczy oraz Archiwum Wojskowego w Toruniu). W kolejnym rozdziale omówiono ustawę rehabilitacyjną obowiązującą w Federacji Rosyjskiej oraz odniesiono jej przepisy do polskiej ustawy o uznaniu za nieważne orzeczeń wydanych wobec osób represjonowanych za działalność na rzecz niepodległego bytu Państwa Polskiego. Ostatni rozdział pracy doktorskiej stanowią uwagi de lege ferenda, za pomocą których wskazano propozycje zmian w ustawie lutowej.
The theme of the dissertation is the procedure for recognition as invalid the judgments issued against people repressed and the proceedings for a compensation for people wrongly persecuted on the basis of the Law of 23 February 1991 on recognition as invalid the judgments rendered against persons persecuted for their activity for the independent Polish State. The aim of the dissertation is, firstly, to show the specificity of the procedure for recognition as invalid and the proceedings for compensation and damages. The chapters of this thesis illustrate the process of creation of the rehabilitation Act. The following problems are discussed: the procedure for the annulment of the repressing decision, the status of the process of a repressed person, the subject of control and the course of proceedings, the concepts of compensation proceedings are indicated and the compensation claims for damage caused by repression are analyzed. Subsequently, the results of the research on the court files are presented. The territorial scope of the research was narrowed down to the area of jurisdiction of the District Court in Poznan and the Military District Court in Poznan (involves also the study in the Military Garrison Court in Wroclaw, Institute of National Remembrance in Bydgoszcz and Military Archives in Torun). The next chapter discusses the rehabilitation law in force in the Russian Federation and considers it referring to the provisions of the Polish Act. The last chapter of the dissertation provides the de lege ferenda comments, which contain suggestions for changes in the discussed Act of Law.
