Position of the self-governing region in the political system of Poland and France - comparative analysis
Abstract
Samorząd stanowi integralną częścią systemu politycznego państwa demokratycznego. Jego samodzielność można uznać za jeden z istotnych wyznaczników poziomu wolności i podmiotowości obywatelskiej w danym kraju, a efektywne wykonywanie przez władze lokalne i regionalne powierzonych im zadań wydatnie wzmacnia poziom partycypacji mieszkańców w funkcjonowaniu państwa prawa. Samorząd może funkcjonować wyłącznie w państwie zdecentralizowanym. Wraz z przekazywaniem zadań jednostkom samorządu terytorialnego władze powinny zatem scedować uprawnienia, środki i odpowiedzialność, by mogły być one w pełni samodzielne w swoich działaniach. Głównym celem pracy jest więc określenie pozycji regionu w systemie politycznym Polski i Francji. Do celów szczegółowych należy natomiast: wskazanie cech konstytutywnych regionów francuskich i polskich, wskazanie przełomowych momentów dla procesu regionalizacji w historii rozwoju samorządności obu państw, określenie w jaki sposób mieszkańcy wspólnot regionalnych włączani są w działania regionów, określenie relacji pomiędzy władzami centralnymi a samorządowymi, określenie pozycji reprezentanta władz centralnych w strukturze regionu, wskazanie, która z tendencji – centralistyczna czy decentralistyczna dominuje w dyskursie politycznym, zobrazowanie w jaki sposób regiony wykorzystują swoje możliwości działania na arenie międzynarodowej oraz wskazanie podstawowego kierunku rozwoju tego szczebla samorządu w obu państwach. Hipoteza podstawowa brzmi region, w systemie politycznym Polski, mimo reform o charakterze decentralizacyjnym, nadal nie ma w pełni samorządowego charakteru; we Francji natomiast przeciwnie, dzięki zmianom wprowadzonym w ramach ostatniej reformy stał się on podmiotem samorządowym.
The local (regional) government constitutes part of political system of a democratic country. Its independence can be considered as one of the essential indicators of the level of freedom and citizen subjectivity in a certain country and effective performance by the regional and local authority of the assigned tasks considerably strengthens the level of the citizen participation in the functioning of state of law. The local (regional) government can function exclusively in a decentralized state. Along with passing over the tasks to the local government units the authorities should thus provide the eligibilities, the means and responsibility so that they can be fully independent in their procedings. The main objective of the paper is to determined the position of a region in political system of France and Poland. To the specific purposes belong: indicating the main characteristics of the region of France and Poland, indicating the break-through moments for regionalization process in history of the regional government development of both countries, determining the way in witch the citizens of regional communities are included in the regional actions, determining relations between central and regional governments, determining the position of the central authority representative in the regional structure, pointing witch one of the tendencies centralize on decentralized domineers in the political discourse, depicting the way in witch the regions utilize their abilities to act on international area and pointing the main direction of development of this in local (regional) government rank in both countries. The original hypothesis states that the region, in the Polish political system despite the decentralizing nature of the reforms still does not have a character of a local government in the full meaning. Contrary, in France, due to a changes implemented as a part of the recent reform it has become local government subject.
