Legal and Financial Aspects of Local Self-government Insolvency
Abstract
Celem pracy jest rozwiązanie problemu niewypłacalności jednostek samorządu terytorialnego w sposób, który ma doprowadzić do poprawy skuteczności systemu finansowego w Polsce. W tym celu wykorzystuję w pracy szereg metod badawczych stosowanych przez jurysprudencję, wśród których przewodnią rolę odgrywa metoda dogmatyczna i prawnoporównawcza. Praca składa się z dwóch części. Część pierwsza, obejmująca pierwszy, drugi, trzeci i czwarty rozdział, ma charakter doktrynalno-teoretyczny. W rozdziale pierwszym rozwiązuję problemy terminologiczne niewypłacalności jednostek samorządu terytorialnego. W rozdziale drugim odtwarzam prawne podstawy niewypłacalności jednostek samorządu terytorialnego z określonych wartości i celów prawa. W rozdziale trzecim identyfikuję przyczyny, skutki i etapy niewypłacalności jednostek samorządu terytorialnego. W czwartym rozdziale prezentuję koncepcję upadłości jednostek samorządu terytorialnego. Część druga, obejmująca piąty, szósty i siódmy rozdział, ma wymiar stricte normatywny. W rozdziale piątym charakteryzuję obce rozwiązania prawne dotyczące niewypłacalności jednostek samorządu terytorialnego na przykładzie prawodawstwa amerykańskiego, niemieckiego, węgierskiego i włoskiego. W szóstym rozdziale prezentuję europejskie rozwiązania prawne dotyczące niewypłacalności jednostek sektora publicznego. Z kolei w rozdziale siódmym analizuję polskie rozwiązania prawne dotyczące niewypłacalności jednostek samorządu terytorialnego.
This dissertation deals mainly with the legal and financial aspects of local self-government insolvency. Other aspects of local self-government insolvency are mentioned only about the public debt. The investigation comprises two parts. The main body of the dissertation is divided into seven chapters. Chapter I outlines the relevant terminological field of local self-government insolvency. Chapter II analyses the current legal situation in Poland, where there is no such thing as local self-government insolvency. The institution of local self-government insolvency can be deduced analytically from the interpreting of numerous provisions of public law such as constitutional law, financial law, administrative law. Chapter III explains why the local self-government is insolvent and what challenges stem from the determining factor of its insolvency. Central to this dissertation are the problems discussed in chapter IV to VI. At the outset, chapter IV explains the legal concepts of local self-government insolvency. In this chapter IV, is presented new law, which engages in reform-oriented movements that seek to modify current types of bankruptcy proceedings’ in Polish law. Chapter V is the study of differences and similarities between foreign bankruptcy legislation, including civil law system, common law system and the European Union law system. Chapter VII completes the analyses by showing how the local self-government is protected from the risk of insolvency in Poland.
