Interwencja humanitarna w obronie praw człowieka we współczesnych stosunkach międzynarodowych

Abstract

Celem dysertacji była pogłębiona analiza interwencji humanitarnej, rozumianej jako reakcja społeczności międzynarodowej z użyciem siły na naruszenia fundamentalnych praw człowieka, praktyka działania w tym zakresie państw i organizacji międzynarodowych oraz wskazówki dla takich działań w przyszłości. Osiągnięcie celów rozprawy nastąpiło przez weryfikację przyjętych hipotez badawczych i powiązanych z nimi tez. Funkcje pomocnicze pełniły pytania badawcze. Wykorzystano metody badawcze charakterystyczne dla nauk o polityce. Obszar badawczy zawężono do lat 1990-2011. Rozprawę doktorską poprzedzono spisem treści i Wstępem. Dysertacja podzielona została na pięć rozdziałów podzielonych na podrozdziały. Na końcu zamieszczono Zakończenie, spis rysunków oraz zestawienie wykorzystanej bibliografii. Interwencja humanitarna stanowi konsekwencję uznania przez społeczność światową fundamentalnych praw człowieka za wartość chronioną na poziomie międzynarodowym i ponosi ona zbiorową odpowiedzialność za ochronę ludzi przed ludobójstwem, zbrodniami przeciwko ludzkości i zbrodniami wojennymi. Poszanowanie i ochrona praw człowieka eliminuje źródła konfliktów wewnętrznych, przez co pozytywnie wpływa na rozwój bezpieczeństwa międzynarodowego. Zdolność do formułowania i wdrażania takich działań (interwencji humanitarnej) manifestują państwa, których polityka mieści się w nurcie koncepcji liberalnej teorii stosunków międzynarodowych. Kolejnym etapem instytucjonalizacji interwencjonizmu prohumanitarnego jest uznanie obowiązku w miejsce prawa do interwencji humanitarnej.

The aim of the dissertation was a analysis of humanitarian intervention, understood as a reaction of the international community, with the use of force to violations of fundamental human rights and the practice of action in this field by states and international organizations and guidelines for such actions in the future. Achievement of the goals of the dissertation was accomplished by verifying the accepted research hypotheses and related theses. Auxiliary functions fulfilled by research questions. Research methods characteristic of political sciences were used. The research area was limited to the years 1990-2011. The dissertation was preceded by a list of contents and an introduction divided into individual sub-chapters. Finally, there is the Ending, a list of drawings and a summary of the bibliography used. Humanitarian intervention is a direct consequence of the recognition of fundamental human rights by the world community as a protected value at international level and it bears collective responsibility for protecting people from genocide, crimes against humanity and war crimes. Respect for and protection of human rights eliminates sources of internal conflicts, thus positively influencing the development of security at the international level. The ability to formulate and implement such activities is manifested by countries whose politics fall under the concept of the liberal theory of international relations. The next stage of the institutionalization of pro-humanitarian interventionism is the recognition of the obligation in place of the right to humanitarian intervention.
