Handel równoległy produktami leczniczymi w prawie unijnym. Granice swobody przepływu towarów na rynku farmaceutycznym

Abstract

Rozprawa doktorska poświęcona została problemowi handlu równoległego produktami leczniczymi na obszarze UE i granicom swobodnego przepływu towarów na rynku farmaceutycznym. Przedmiotem rozprawy jest problem ograniczania zjawiska handlu równoległego, tak przez producentów produktów leczniczych, jak i przez państwa członkowskie UE. Zagadnienie to analizowane jest zarówno w świetle regulacji podlegających kontroli zgodności z art. 34 i 36 TFUE, takich jak przepisy unijnego prawa farmaceutycznego i prawa własności intelektualnej, jak również w świetle regulacji prawa konkurencji – art. 101 i 102 TFUE. W zakresie prawa farmaceutycznego analizie poddane zostały przepisy dotyczące bezpieczeństwa obrotu produktami leczniczymi, powodujące ograniczenia tego obrotu. Na gruncie prawa własności intelektualnej przeanalizowana została koncepcja wyczerpania praw własności intelektualnej i jej ograniczenia. Wreszcie w zakresie prawa konkurencji omówiony został problem porozumień prowadzących do ograniczenia handlu równoległego oraz jednostronnych działań przedsiębiorców dominujących ograniczających taki handel. Specjalna uwaga poświęcona została także zagadnieniu regulacji przez państwa członkowskie rynku farmaceutycznego poprzez mechanizmy mające na celu obniżanie cen produktów leczniczych. The thesis treats the problem of the parallel trade of pharmaceuticals in the EU and of the limits of free circulation of goods on the pharmaceutical market. It’s main point is the question of restricting parallel trade both by pharmaceutical producers and Member States. This question has been analyzed in the light of provisions being subject to the verification of their compatibility with articles 34 and 36 of the TFEU, such as provisions of the European Union’s pharmaceutical law and intellectual property law as well as in the light of regulations of the competition law – articles 101 and 102 of the TFEU. In the field of pharmaceutical law the research has been concentrated on the provisions concerning the security of the circulation of pharmaceuticals and their influence on that circulation. In the domain of intellectual property law the analysis has been focused on the limits of the principle of exhaustion. Finally, as regards competition law, the objects of the research have been the questions of agreements restricting the parallel trade and of unilateral actions of dominant entrepreneurs to the same end. Particular attention has been also granted to the problem of interventions of Member States on the pharmaceutical market aimed at cutting prices of pharmaceuticals.
