Środki o skutku równoważnym do ograniczeń ilościowych w przywozie w rozumieniu art. 34 Traktatu o funkcjonowaniu Unii Europejskiej

Abstract

Ogólnym celem pracy jest dokonanie rekonstrukcji zakazu stosowania środków o skutku równoważnym do ograniczeń ilościowych w przywozie (ŚOR) ustanowionego w art. 34 TFUE. Praca składa się z pięciu rozdziałów. Pierwszy ma charakter wprowadzający oraz zawiera podstawowe ustalenia dotyczące zakresu zastosowania interpretowanego przepisu. Rozdział drugi dotyczy problemu tzw. bezpośredniego skutku horyzontalnego, tj. możliwości powoływania się przeciwko jednostce w postępowaniu krajowym na art. 34 TFUE. W rozdziale trzecim przedstawiono rozwój orzecznictwa Trybunału Sprawiedliwości na temat ŚOR do 2009 r. Rozdział czwarty zawiera analizę późniejszego orzecznictwa, ze szczególnym uwzględnieniem wykładni kryterium ograniczania dostępu do rynku. Rozdział piąty poświęcony został omówieniu wyjątków od analizowanego w pracy zakazu stosowania ŚOR.

The general aim of this work is to reconstrue legally the prohibition of measures having equivalent effect to quantitative restrictions in imports provided in Art. 34 TFEU. The work consists of five chapters. The first one has an introductory character and contains the basic assumptions concerning the scope of application of the said provision. The second chapter deals with the issue of so-called horizontal direct effect, i.e. the possibility of invoking (or applying) Art. 34 TFEU in national proceedings directly against private party. In the third chapter I have discussed the evolution of the Court of Justice’s pre-2009 case-law concerning the discussed matter. The fourth chapter contains in-depth analysis of recent case-law, where special emphasis was put on the notion of hindering market access. The fifth chapter is devoted to the issue of exemptions to the discussed prohibition of applying measures having equivalent effect to quantitative restrictions.
