Role of the police in the Polish criminal procedures
Abstract
Zadaniem pracy było zaprezentowanie roli Policji w polskim procesie karnym. Analizy dokonano w oparciu o regulacje prawne, literaturę i orzecznictwo. Wymiar praktyczny przedstawiono w ujęciu statystycznym. Porównawczo uwzględniono obraz roli Policji w procedurze karnej niemieckiej i austriackiej. Praca zawiera siedem rozdziałów, wstęp i uwagi końcowe. Rozdział I obejmuje rozważania dotyczące zadań i uprawnień Policji, w tym zadań, jakie wobec Policji stawia współczesne państwo. Rozdział II dotyczy ewolucji uprawnień i zadań Policji w polskim postępowaniu karnym.Rozdział III stanowi analizę szerokiej problematyki roli Policji w postępowaniu przygotowawczym. W rozdziale IV omówiono znaczenie czynności operacyjno-rozpoznawczych dla postępowania karnego.Rozdział V dotyczy roli Policji w stadium jurysdykcyjnym z uwzględnieniem postępowań szczególnych. W rozdziale VI przedstawiono rolę Policji w postępowaniu karnym wykonawczym. W rozdziale VII w aspekcie prawnoporównawczym wzięto pod uwagę rolę Policji w postępowaniu karnym w Niemczech i Austrii.Przyjęta konstrukcja pozwoliła na kompleksową analizę tematu, biorąc m.in. pod uwagę obszerność zagadnienia, czy też fakt, iż wśród uczestników postępowania karnego Policję wyróżnia wielość zadań i funkcji, które spełnia w procesie karnym.
The aim of this dissertation was to present the role of the police in the Polish criminal procedures. The analyses were conducted on the bases of legal procedures, literature and case law. The practical part was explained through the statistics; while, the image of the police role in the Austrian and German criminal procedures was presented through the comparison. The dissertation consists of seven chapters, the introduction and final comments. The chapter I contains the considerations about the objectives and rights of the police especially those which are posed by the modern society. The chapter II presents the development of the objectives and rights of the police in the Polish criminal procedures.The chapter III performs the analysis of the broad issue of the police role in the pre-trial proceedings. The chapter IV explains the importance of the operational intelligence activities in the criminal procedures.The chapter V presents the role of the police in judicature stage including the special proceedings.The chapter VI explains the role of the police in enforcement proceedings.The chapter VII contains the comparative legal analysis of the police role in the Austrian and German criminal procedures.The structure of the dissertation allowed for the complex analysis of the problem by taking into account not only the broadness of the issue, but also the fact that among the participants of the criminal procedures, the police is marked out by the variety of its objectives and rights within this process.
