| dc.description.abstract | The protection of air quality regarding its smell is a challenge for the Polish legislator due to the increasing number of complains about burdensome emissions of offensive odours by some business entities operating in the agricultural or industrial sector. Despite several attempts to do so, there has been no act adopted entirely to regulate this matter. The existing provisions refer only to the problem of nagging smells and norms that might reduce their intensity. In the author’s opinion efficient protection against burdensome odours must be accounted for already at the stage when new installations are made. Firstly, new investments should be located at a distance from residential districts. It may be helpful to plant green belts that would absorb the smell produced and emitted in the environment. Another solution is an obligatory requirement to invest in technology reducing the emission of odours. | pl |
| dc.description.abstract | La tutela olfattiva della qualità dell’aria costituisce una sfida per il legislatore polacco a causa di un numero crescente di lamentele per le emissioni di odori fastidiosi dovute all’attività di alcuni operatori del settore agricolo e industriale. Finora, nonostante diversi tentativi intrapresi, nessun atto giuridico dedicato esclusivamente alla materia in questione è stato approvato. In vigore ci sono tuttavia norme che riguardano il problema di molestie olfattive in modo indiretto, esse possono portare a ridurne l’impatto. A parere dell’autrice, una efficace protezione contro l’emissione di odori deve essere presa in considerazione già nella fase di investimento per i nuovi impianti, il cui funzionamento potrà portare a emissioni di sostanze odorose. Pertanto, per quanto possibile, essi dovrebbero essere situati lontano da complessi residenziali. Efficace potrebbe rivelarsi anche l’introduzione di un obbligo di provvedere a creare le c.d. cinture verdi, capaci di assorbire sostanze ad azione olfattiva. Sarebbe altrettanto importante obbligare operatori di impianti a introdurre tecniche in grado di portare alla più bassa emissione di odori. | pl |
