Administrative Proceedings and Administrative Court Proceedings Relating to State Aid Financed by the European Agriculture Fund for Rural Development
Abstract
W pracy przedstawione zostały zagadnienia postępowania administracyjnego i sądowoadministracyjnego dot. systemu realizacji programu sektorowej pomocy publicznej w dziedzinie branży rolno-spożywczej oraz przeznaczonej na rozwój obszarów wiejskich. Realizowany jest on w ramach jednego z funduszy strukturalnych Unii Europejskiej. Zakres obszernej tematyki niniejszej pracy wymagał uporządkowania jej w sposób pozwalający na przedstawienie zagadnień skomplikowanego systemu kooperacji działalności Komisji Europejskiej, krajowych organów administracji publicznej oraz beneficjentów realizujących cele PROW 2007-2013. Dlatego też w pierwszej części zostały przedstawione zagadnienia dot. warunków dopuszczalnej pomocy publicznej oraz prawidłowego przygotowania programu pomocowego przez każde państwo członkowskie Unii Europejskiej. Kolejna część pracy została poświęcona doświadczeniom związanym z realizacją na obszarze Rzeczpospolitej Polskiej wcześniejszych tzw. unijnych programów pomocowych. W pracy przedstawiona została również klasyfikacja współczesnych form działania administracji wdrażającej programy pomocowe w ramach unijnej zasady autonomii proceduralnej prawa polskiego. Wskazane zostały w nim formy znajdujące zastosowanie w ramach PROW 2007-2013. W dalszej części pracy przedstawione zostały warunki postępowań w sprawie przyznania pomocy PROW 2007-2013 oraz zakres kontroli sądowej decyzji dot. odmowy przyznania pomocy. Ostatnia część pracy dot. wykonania rozstrzygnięć o przyznaniu pomocy beneficjentom programu. W pracy przedstawione zostały także założenia dot. warunków procedury przyznania pomocy w ramach nowego programu pomocy strukturalnej PROW 2014-2020, które oparte zostały w całości na rozwiązaniach programu opisanego w niniejszej pracy.
This doctoral dissertation presents issues concerning administrative proceedings and administrative and court proceedings relating to the implementation system of sectoral state aid schemes in the agri-food sector and in rural areas. The system is being implemented for one of the EU structural funds. The extended subject matter of this dissertation has been organized in a way that enables the presentation of the complex nature of the cooperation system between all the parties involved in implementing the objectives of the Rural Development Programme 2007-2013: the EU, national public administration authorities and the beneficiaries. Therefore, the first part of the thesis presents the requirements related to allowable public aid as well as the issues concerning the proper preparation of state aid schemes by each Member State. The following part of the dissertation describes the existing experience acquired while implementing similar state aid schemes in the territory of Poland. The thesis also identifies contemporary action forms of administrative authorities responsible for implementing state aid within the EU’s principle of national procedural autonomy. Some of these action forms were adopted while implementing the Rural Development Programme 2007-2013. The next part of the thesis presents proceedings conditions to grant the aid within Rural Development Programme 2007-2013 as well as the scope of review by the Courts for refusals to grant the aid. The final part of the dissertation deals with execution of the court’s decisions to grant the aid to the Programme beneficiary. This dissertation also includes assumptions for the new Rural Development Programme 2014-2020, which have been developed solely on the basis of the solutions described in this thesis.
