Granice niezależności banku centralnego w Unii Europejskiej

Abstract

Przedmiotem rozprawy jest wybrana problematyka związana z instytucjonalnym ujęciem polityki pieniężnej w Unii Europejskiej. Obejmuje ona zagadnienie niezależności Europejskiego Banku Centralnego. Celem naukowym rozprawy jest zbadanie niezależności banku centralnego w ujęciu jurydycznym i próba wyznaczenia granic. Przestrzeń badawczą dla rozprawy stanowi instytucjonalna struktura polityki monetarnej w UE. Pierwsza część analizy obejmuje przybliżenie problematyki zagadnienia niezależności banku centralnego w ujęciu nauk ekonomicznych poprzez syntetyczne ujęcie głównych stanowisk naukowych w tym zakresie. W dalszej części rozprawa zawiera analizy prawne. Składają się na nie rozważania nad strukturą instytucjonalną UE i miejscem systemu jednolitej polityki pieniężnej w jej ramach. Ponadto, scharakteryzowane zostają cztery wymiary niezależności banków centralnych wskazane przez Europejski Instytut Walutowy oraz rozróżnienie formalnego i realnego aspektu niezależności banku centralnego. W dalszej kolejności, następuje identyfikacja obszarów kompetencyjnych EBC oraz wyznaczenie granic niezależności w ujęciu realnym, czyli delimitacja obszarów istnienia samodzielnej kompetencji banku. Rozprawa podejmuje również zagadnienie legitymowanej kontroli oraz demokratycznej legitymizacji banku centralnego w UE.

The thesis applies to selected issues related to the institutional view of monetary policy in the European Union. It encompasses the issue of the European Central Bank’s independence. The scientific objective of this thesis is to analyse the independence of the central bank in legal terms with the simultaneous attempt to set the limits of this independence. The research area for the thesis is the institutional structure of monetary policy in the EU. The objective of the first part of the analysis is to discuss the issue of the independence of the central bank in economic science terms through a summary presentation of the main scientific positions on this. The second part of the thesis encompasses the legal considerations. It consists of considerations regarding the institutional structure of the EU and the place of the system of a uniform monetary policy within its framework. Furthermore, this section of the thesis contains a legal description of the four dimensions of independence of central banks specified by the European Monetary Institute and the differentiation between the formal and legal aspect of the independence of the central bank. Next, the areas of competence of the ECB are identified as well as setting the limits of independence in real terms, namely the delimitation of the areas of the existence of the bank’s independent competence. The thesis considers also the issue of legitimated control and democratic legitimation of the central bank in the EU.
